MINUTES <br />CITY COUNCIL <br />MAY 149 2025 <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2025-5-72 — APPROVING A VARIANCE FOR LOT DEPTH TO BE <br />125.4 FEET WHEN 13 0 IS REQ UIRED A T 49 OLD CO UNTY R OAD C WITH THE <br />FINDINGS OF FA CT AS OUTLINED IN THE STAFF REPORT <br />The foregoing resolution was duly seconded by Miller. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />CONSIDER ORDINANCE 912 AMENDING ZONING CODE CHAPTERS 904 AND 915 <br />RELATING TO FENCES <br />The Community Development Director provided background information about fences and walls, <br />identifying issues with the current city code language. He reviewed the proposed code amendments as <br />reviewed and recommended by the Planning Commission, noting items for the Council to consider. <br />Mayor Fischer opened the public hearing for comments from the general public. <br />There were no comments from the public. Upon motion by Miller, seconded by Gutierrez, the public <br />hearing was closed. Ayes (5). Nays (0). Motion adopted. <br />Malone agreed that these changes will create efficiency for staff. She asked if it would be up to the <br />homeowner whether they receive an official land survey of the property lines. The Community <br />Development Director confirmed that is correct as the city currently accepts estimates of the property <br />line. He stated that in the event of a conflict that would be between property owners and the city <br />would not be involved. He noted that two surveys can often provide different results, and the city does <br />not want to be involved in those disputes. He stated that sometimes a letter is required from a neighbor <br />that states they do not object to the fence placement, acknowledging that it could be on the property <br />line. <br />Miller asked for clarification on a chain link fence and whether it would be allowed for a front yard. <br />The Community Development Director confirmed that a chain link fence would still be allowed and <br />reviewed the regulations that would exist for a front yard. <br />Gutierrez asked for clarification on the allowed height for a fence on a corner lot. The Community <br />Development Director provided additional details on the height that would be allowed on an arterial <br />roadway, as long as the corner sightlines are preserved. <br />Malone introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2025-5-73 — APPROVING ORDINANCE 912 TO AMEND <br />CHAPTERS 904 AND 915 OF THE LITTLE CANADA ZONING CODE RELATING TO <br />FENCES AND APPROVING A SUMMAR PUBLICATION OF THE ORDINANCE <br />The foregoing resolution was duly seconded by Kwapick. <br />Ayes (5).
