MINUTES <br />CITY COUNCIL <br />FEBRUARY 14, 1996 <br />The Building Official replied that the accessibility <br />code requires an accessible interior route from one <br />level to another and to every room. If the City were <br />to maintain both levels for assembly purposes, an <br />elevator or ramp would have to be added to the building <br />to provide handicapped access between the two floors. <br />Morelan suggested that the City might lease one of the <br />floors to a business, thus there would be two different <br />entities occupying the building. Morelan asked if the <br />Code would still require accessibility between the two <br />levels. <br />The Building Official replied that was his <br />understanding of the Code. <br />Fahey suggested that the City Attorney give the Council <br />a legal opinion on the accessibility issue. Fahey <br />suggested that it did not make sense to require <br />handicapped accessibility between two floors of a <br />building when each floor is being used by different <br />entities. If this is the case, Fahey suggested that a <br />meeting with local Legislators was in order. <br />The Building Official reported that the State has <br />adopted the UBC as part of its State Building Code. <br />The Buildinq Official indicated that he checked his <br />interpretation with the State on the issue of access <br />between levels, and they indicated that his <br />interpretation was correct. There is an exception for <br />areas 3,000 square feet or less, but the exception does <br />not apply to public buildings. A public building is <br />defined as any building funded with State or Local <br />money. <br />Fahey asked if the building were deeded to LCRA or the <br />Historical Society whether the exception would apply. <br />The Building Official pointed out that this was a <br />possibility, but he thought the building exceeded 3,000 <br />square feet. <br />The City Administrator pointed out that if the building <br />were condo'ed off, handicapped accessible restrooms <br />would be needed on each level. There would also be the <br />expense of drafting and recording the legal documents <br />to turn title over to the various organizations.
