MINUTES <br />CITY COUNCIL <br />MAY 8, 1996 <br />*APPROVING THE REVISED STREETSCAPE PROPOSAL AS <br />SUBMITTED BY IIOISINGTON KOEGLER GROUP, INC.; <br />*APPROVING VALLEY PAVING~S REQUEST FOR PAYMENT IN THE <br />AMOUNT OF $30,877.11; <br />*APPROVING PAYMENT OF THE VOUCHERS <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) LaValle, Morelan, Scalze, Pedersen, Fahey. <br />Nays (0). Resolution declared adopted. <br />VALLEY The City Attorney reported that the League of Minnesota <br />PAVING - Cities Insurance Trust has denied coverage in the <br />BREACH Valley Paving versus City of Little Canada breach of <br />OF contract lawsuit. Therefore, the City Attorney's <br />CONTRACT office is in the process of putting together an answer <br />to the suit on behalf of the City. <br />HERITAGE The Administrative Assistant reviewed her May Sth <br />OFFICE PARK memo outlining Real Estate Masters' request that the <br />DEVELOPMENT Council table action on the Heritage Office Park <br />AGREEMENT Development Agreement. The Assistant pointed out that <br />Real Estate Masters has not completed negotiations with <br />Heritage Development Corporation, therefore, prefers <br />that the City not enter into the Development Agreement <br />with Heritage at this time. <br />Fahey expressed concern about the City's tabling action <br />on the Development Agreement without there being prior <br />knowledge on the part of Heritage Development <br />Corporation. <br />Pedersen pointed out that at this point Heritage <br />Development Corporation is not the owner of the <br />property in question. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 96-5-111 - TABLING ACTION ON THE <br />HERITAGE OFFICE PARK DEVELOPMENT AGREEMENT AT THE <br />REQUEST OF THE PROPERTY OWNER, REAL ESTATE MASTERS <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Fahey, LaValle, Pedersen. <br />Nays (0). Resolution declared adopted. <br />
