MINUTES CITY COUNCIL MAY 8, 1996 *APPROVING THE REVISED STREETSCAPE PROPOSAL AS SUBMITTED BY IIOISINGTON KOEGLER GROUP, INC.; *APPROVING VALLEY PAVING~S REQUEST FOR PAYMENT IN THE AMOUNT OF $30,877.11; *APPROVING PAYMENT OF THE VOUCHERS The foregoing resolution was duly seconded by Morelan. Ayes (5) LaValle, Morelan, Scalze, Pedersen, Fahey. Nays (0). Resolution declared adopted. VALLEY The City Attorney reported that the League of Minnesota PAVING - Cities Insurance Trust has denied coverage in the BREACH Valley Paving versus City of Little Canada breach of OF contract lawsuit. Therefore, the City Attorney's CONTRACT office is in the process of putting together an answer to the suit on behalf of the City. HERITAGE The Administrative Assistant reviewed her May Sth OFFICE PARK memo outlining Real Estate Masters' request that the DEVELOPMENT Council table action on the Heritage Office Park AGREEMENT Development Agreement. The Assistant pointed out that Real Estate Masters has not completed negotiations with Heritage Development Corporation, therefore, prefers that the City not enter into the Development Agreement with Heritage at this time. Fahey expressed concern about the City's tabling action on the Development Agreement without there being prior knowledge on the part of Heritage Development Corporation. Pedersen pointed out that at this point Heritage Development Corporation is not the owner of the property in question. Mr. Morelan introduced the following resolution and moved its adoption: RESOLUTION NO. 96-5-111 - TABLING ACTION ON THE HERITAGE OFFICE PARK DEVELOPMENT AGREEMENT AT THE REQUEST OF THE PROPERTY OWNER, REAL ESTATE MASTERS The foregoing resolution was duly seconded by Scalze. Ayes (5) Morelan, Scalze, Fahey, LaValle, Pedersen. Nays (0). Resolution declared adopted.
