MINUTES CITY COUNCIL MAY 22, 1996 would have to show a hardship or uniqueness which would warrant granting a variance. Fahey felt 1,500 square feet was a lot of accessory area. Scalze asked if the City had better control if a 1,500 square foot cap was part of the ordinance or a policy. Fahey felt there was better control if the limitation was part of the ordinance and pointed out that the City would avoid situations where decisions would appear arbitrary. Morelan felt amending the ordinance resulted in being too restrictive. Morelan also stated that garage/accessory space has not been an issue, pointing out that past Conditional Use Permit approvals have been for accessory space in the 1,200 to 1,300 range. An ordinance amendment capping this space at 1,500 square feet may encourage people to put up the largest accessory building they could. Fahey pointed out that these accessory buildings would still have to meet setbacks. The City Administrator noted that a public hearing is required to consider amending the Zoning Code. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION N0. 96-5-124 - CALLING A PUBLIC HEARING FOR WEDNESDAY, JUNE 26, 1996 TO CONSIDER AMENDING THE ZONING CODE RELATIVE TO CONDITIONAL USE PERMITS PLACING A CAP OF 1,500 SQUARE FEET ON TOTAL GARAGE/ACCESSORY BUILDING AREA The foregoing resolution was duly seconded by Pedersen. Ayes (4) Fahey, Pedersen, LaValle, Scalze. Nays (1) Morelan. Resolution declared adopted. COMP PLAN The City Planner submitted a proposed timetable for UPDATE finalizing the adoption of the Comprehensive Plan update. Morelan indicated there seems to be some confusion about the need for neighborhood meetings.
