Resolution declared adopted. <br />PUBLIC Fahey opened the Public Hearing to consider application <br />HEARING - for a Property Division and Variance from the require- <br />PROPERTY ment of frontage on an improved public street for <br />DIVISION & property owned by Ron Palmen on McMenemy Road. It was <br />VARIANCE, noted that the Planning Commission recommended approval <br />PALMEN of the request. The City Engineer has submitted a <br />PROPERTY ON report on this application which raises concern about <br />MCMENEMY utility issues. Fahey described past Council actions <br /> in similar requests such as the Stewart property <br /> division where the City approved the division provided <br /> that an improved road was put in to access the <br /> property. The Keenan variance request was approved <br /> subject to a driveway being paved on road right-of-way <br /> and with the condition that should one more home be <br /> built on this street, the road would be improved to <br /> City standards, and the Keenan's deemed in favor of the <br /> improvement. <br /> Fahey indicated that approval of this request would set <br /> a precedent since the City would be allowing creation <br /> of a lot and construction of a home accessed via a <br /> private driveway. <br />Mary Kay Voosen, applicant, stated that she and her <br />husband, Brad Pelletier, would like to build a house on <br />the new lot and access the house via the existing <br />driveway. The lot is being laid out in such a way so <br />it would not interfere with future development of the <br />area. Voosen pointed out the Maranda property on <br />LaBore Road developed with a private driveway accessing <br />a couple of homes. <br />Scalze pointed out the Maranda property was developed <br />prior to the City's Subdivision Ordinance being <br />updated. <br />Fahey used his own property as an example pointing out <br />that he has 3 acres behind his house. If this request <br />is approved, the same concept could be applied to his <br />property. <br />12 <br />
