MINUTES <br />CITY COUNCIL <br />JUNE 26, 1996 <br />Green reported that these companies will not allow APT <br />to locate on their tower. <br />Fahey suggested the City require as part of the CUP <br />that Green would have to allow co-locations on his <br />tower at market-rate rents. <br />The Administrator suggested the City could impose those <br />conditions, but he did not know whether it was legally <br />enforceable. The City Attorney commented that he was <br />not sure such conditions would be enforceable. <br />Morelan pointed out the City has no obvious reason to <br />deny the CUP. <br />Scalze felt a reason was so the Council could set up a <br />tower plan for the City. <br />Pedersen suggested as cells get smaller, the number of <br />towers will be doubled. <br />Scalze pointed out the City already has three towers, <br />and the City needs to plan for what is in its best <br />interest. Scalze asked if rent for placement of <br />antennas on the City's water tower was competitive. <br />Scalze felt the City needed a policy plan addressing <br />these issues. <br />Pedersen felt antennas on the water tower and free- <br />standing towers were separate issues. <br />LaValle suggested perhaps the City should build the <br />towers and then rent to the various companies needing <br />to place antennas. LaValle asked Green if this was <br />acceptable to him. <br />Green replied it was as long as the tower fit within <br />their grid plan and the rent was at fair market value. <br />Green pointed out the Donovan property location fits <br />within their grid plan and is a key location. Green <br />reported he is also in discussions with the City <br />Administrator regarding the location of antennas on the <br />water tower. The water tower is another key location <br />within their grid system. <br />Fahey pointed out the issue of Green allowing co- <br />locations on his tower and leasing the tower at a rate <br />not to exceed what he is paying the City for lease of <br />the water tower or within a reasonable range of that <br />amount. <br />21 <br />
