MINUTES <br />CITY COUNCIL <br />JULY 24~ 1996 <br />RESOLUTION N0. 96-7-172 - APPROVING THE DIVISION OF <br />LOTS 25 THROUGfi 29, BLOCK 5, NORTH HEIGHTS PLUS VACATED <br />LAKE STREET ACCRUING INTO TWO SINGLE-FAMILY LOTS <br />SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF TAE <br />CITY PLANNER AS OUTLINED IN HIS REPORT DATED JULY 8, <br />1996, SUBJECT TO COMPLIANCE WITH TI~IE RECOMMENDATIONS OF <br />TI-IE PUBLIC WORKS DIRECTOR AS OUTLINED IN IiIS MEMO DATED <br />JULY 18, 1996~ AND SUBJECT TO THE RECOMMENDATION OF TI~IE <br />PARKS & RECREATION COMMISSION WITH REGARD TO PARK <br />CHARGE <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) Morelan, Pedersen, Fahey, Scalze, LaValle. <br />Nays (0). Resolution declared adopted. <br />CUP TO MOVE Fahey opened the Public Hearing to consider a request <br />A HOiJSE ONTO for Conditional Use Permit to move an existing house <br />AN EXISTING onto a single-family lot located at the end of <br />LOT - Australian Avenue. Fahey noted that the Planning <br />AUSTRALIAN Commission has recommended approval of the CUP, and the <br />AVENUE - City Planner has recommended approval subject to the <br />TILLESKJOR house nleeting the City's 800 square foot minimum. The <br />house proposed to be moved in was constructed in 1989. <br />Kirsten Godwalt, 95 Australian Avenue, indicated her <br />only concern was should the temporary cul-de-sac at the <br />end of Australian Avenue be damaged, that it would be <br />repaired. Godwalt reported that she gets some run-off <br />from the cul-de-sac into her yard, and she did not want <br />to see that increased. <br />Scalze noted the City has ordered a feasibility study <br />for the improvement of Australian Avenue. Should the <br />City proceed with the improvement, the run-off problem <br />should be corrected. <br />Fahey indicated that any approval of the Conditional <br />Use Permit would be subject to restoration of the cul- <br />de-sac to its current condition. <br />Steve Morelan indicated he is a property owner in the <br />area, therefore, will abstain from voting on this <br />application. Morelan indicated he wished to address <br />the Council as a property owner. Morelan stated his <br />only concern is the size of the home and its value, and <br />the effect the home may have on other properties in the <br />neighborhood. Morelan pointed out that a letter has <br />been submitted from the Tilleskjor's realtor indicating <br />the house would not devalue surrounding properties. <br />Morelan pointed out that the realtor has a financial <br />3 <br />
