TOM DURAY SUBJECT TO COMPLIANCE WITH <br />ITEM C IN THE CITY PLANNER~S REPORT DATED JULY 8, 1996 <br />BASED ON THE RECOMMENDATION OF THE PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5j LaValle, Fahey, Pedersen, Morelan, Scalze. <br />Nay (0). Resolution declared adopted. <br />Morelan pointed out that a fence is required by <br />ordinance since The Hoggsbreath abuts residential <br />property. However, Mr. Duray would have the option of <br />installing a much less expensive fence. <br />TOBACCO Fahey pointed out that the City has notified those <br />REGULATIONS businesses which hold cigarette licenses that Council <br />would be considering imposing tobacco regulations. The <br />regulations to be considered this evening include <br />imposition of vendor penalties for sale to minors, <br />clerk penalties for sale to minors, restricted access <br />to cigarette vending machines with either a lock-out <br />device or use of tokens, no self-service less than a <br />carton, and compliance ohecks. <br />It was noted that none of the cigarette license holders <br />in the City were present this evening. <br />Morelari asked if staff has given any thought to <br />compliance checks. <br />The City Administrator asked if it was Council's <br />intention that City staff do compliance checks, or if <br />the checks would be done by other agencies. <br />Scalze felt compliance checks should be done by <br />whatever method would be least costly for the City. <br />Fahey asked if lock-out devices on vending machines <br />would be installed by the vending company or the <br />business owner. <br />Morelan assumed the business owner would install the <br />lock-out device. It was pointed out most businesses <br />own their own cigarette vending machines. <br />LaValle felt that having a cigarette vending machine in <br />view of: the proprietor would be adequate. <br />Pedersen felt that assumes there would be someone <br />standing and watching the vending machine at all times. <br />9 <br />
