MINUTES CITY COUNCIL AUGUST 28, 1996 developer should apply for a variance for the cul-de- sac diameter. LaValle suggested this may not be an issue if the cul- de-sac diameter was reduced at the time the road right- of-way minimum was reduced to 50 feet. Fahey suggested Gust work with the City Engineer and City Staff to resolve this issue. If necessary, a variance could be applied for. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 96-8-196 - APPROVING THE FINAL PLAT FOR STONERIDGE ADDITION AS WELL AS VARIANCE FOR STREET RIGHT-OF-WAY WIDTH AT TFIE INTERSECTION OF STONERIDGE COURT AND COUNTY ROAD D SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER AS OUTLINED IN HIS REPORT DATED FEBRUARY 2, 1996, SUBJECT TO THE RECOMMENDATIONS OF THE CITY ENGINEER AS OUTLINED IN HIS REPORT DATED AUGUST 9, 1996, SUBJECT TO PARK CHARGES AS RECOMMENDED BY THE PARKS & RECREATION COMMISSION~ SUBJECT TO THE CLOSING ON THE LAND TRANSACTION WITH THE CITY, AND SUBJECT TO EXECUTION OF A FINAL DEVELOPMENT AGREEMENT The foregoing resolution was duly seconded by Fahey. Ayes (5) LaValle, Fahey, Morelan, Pedersen, Scalze. Nays (0). Resolution declared adopted. CUP FOR Fahey opened the public hearing to consider the request USED CAR for a Conditional Use Permit for a used car sales SALES OFFICE office at Best Auto & Tire located at 3011 Country 3011 COUNTRY Drive. The Planning Commission has recommended DRIVE approval of this request. Scalze felt the Conditional Use Permit should be restricted prohibiting advertising signs. Matt Benson and Dale Madsen reported their business is primarily wholesale, and there are no plans for signs, prices on car windows, balloons, etc. Any retail business would be by referral. There was no one from the general public present wishing to comment on this matter. Upon motion by LaValle, seconded by Morelan, the public hearing was closed. 3
