MINUTES <br />CITY COUNCIL <br />SEPTII~SBER 25, 1996 <br />Fahey did not see a difference which would justify a <br />variance for one property versus the other. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 96-9-229 - GRANTING A 7-FOOT REAR YARD <br />SETBACK VARIANCE FOR 812 ASPEN CIRCLE AS REQUESTED BY <br />MR. DAVID JEBENS CONTINGENT THAT THE SQUARE FOOTAGE OF <br />THE PROPOSED PORCH NOT EXCEED TI-IE SQUARE FOOTAGE OF THE <br />EXISTING DECK, AND BASED ON THE FACT THAT THE ADJACENT <br />PROPERTY OWNER HAS SUBMITTED A LETTER STATING THAT SHE <br />DOES NOT OBJECT TO TI-IE VARIANCE BEING APPROVED <br />The foreqoing resolution was duly seconded by Pedersen. <br />Ayes (2) LaValle, Pedersen. <br />Nays (3) Fahey, Scalze, Morelan. Resolution denied. <br />Fahey felt the two options were that the porch be <br />redesigned to comply with setback requirements, or the <br />Council amend the Code to allow the request. <br />TEXT Fahey pointed out that the Planning Commission <br />AMENDMENT tabled action on the text amendment and Conditional <br />& CUP - Use Permit applications submitted by Di-Med <br />DI-MED Corporation which would allow Grand Slam to <br />CORPORATION operate in a portion of the Di-Med building. The <br />Planning Commission requested information from <br />surrounding cities on the types of commercial <br />recreation uses allowed in their industrial districts. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 96-9-230 - CONTINUING THE PUBLIC HEARING <br />ON TIIE TEXT AMENDMENT AND CONDITIONAL USE PERMIT FOR <br />ADDITIONAL RECREATIONAL USES IN THE BW AND I-P ZONING <br />DISTRICTS UNTIL THE OCTOBER 23~ 1996 REGULAR COUNCIL <br />MEETING PENDING A RECOMMENDATION FROM TIiE PLANNING <br />COMMISSION <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, LaValle, Fahey, Pedersen. <br />Nays (0).
