MINUTES OE THE REGULAR MEETING CITY COUNCIL LITTLE CANADA, MINNESOTA OCTOBER 9, 1996 Pursuant to due call and notice thereof a regular meeting of the City Council of the City of Little Canada, Minnesota was held on the 9th day of October, 1996 in the Council Chambers of the City Center located at 515 Little Canada Road in said City. Mayor Michael I. Fahey called the meeting to order at 7:30 P.M. and the following members of the City Council were present at roll call: CITY COUNCIL ALSO PRESENT Mayor Council Member Council Member Council Member Council Member City Admin. Fahey Mr. Bob Pedersen Mr. Jim LaValle Mr. Steve Morelan Mrs. Beverly Scalze Mr. Joel Hanson Mr. Tom Sweeney Mr. Paul Aeuer Mr. Greg Schroeder Mrs. Kathy Glanzer MINUTES Mr. Morelan introduced the following resolution and moved its adoption: RESOLUTION NO. 96-10-246 - APPROVING TAE MINUTES OF TFiE SEPTEMBER 25, 1996 WORKSHOP COUNCIL MEETING, THE SEPTEMBER 25, 1996 REGULAR COUNCIL MEETING, AND T$E SEPTEMBER 25, 1996 CLOSED COUNCIL MEETING AS SUBMITTED The foregoing resolution was duly seconded by LaValle. GROUP HOME - Mayor Fahey acknowledged the many residents present 3019 THUNDER this evening to discuss the group home to be located BAY ROAD at 3019 Thunder Bay Road. Fahey reported that in the 1980's the State Legislature passed a Statute which made group homes of six or fewer residents a permitted use in a residential area. About that same time, Little Canada was approached with a group home proposal. Because of the opposition of the residents in the area, the City Council denied the group home request. The applicant took the matter to Court, and the Court upheld the State Law which basically says cities have no licensing authority or means to preclude a group home. Therefore, Little Canada has no ability to deny the home proposed for Thunder Bay Road.
