MINUTES OE THE REGULAR MEETING <br />CITY COUNCIL <br />LITTLE CANADA, MINNESOTA <br />OCTOBER 9, 1996 <br />Pursuant to due call and notice thereof a regular <br />meeting of the City Council of the City of Little <br />Canada, Minnesota was held on the 9th day of October, <br />1996 in the Council Chambers of the City Center located <br />at 515 Little Canada Road in said City. <br />Mayor Michael I. Fahey called the meeting to order at <br />7:30 P.M. and the following members of the City Council <br />were present at roll call: <br />CITY COUNCIL <br />ALSO PRESENT <br />Mayor <br />Council Member <br />Council Member <br />Council Member <br />Council Member <br />City Admin. <br />City Attorney <br />City Engineer <br />Cable TV Prod. <br />Admin. Asst. <br />Mr. Michael I. Fahey <br />Mr. Bob Pedersen <br />Mr. Jim LaValle <br />Mr. Steve Morelan <br />Mrs. Beverly Scalze <br />Mr. Joel Hanson <br />Mr. Tom Sweeney <br />Mr. Paul Aeuer <br />Mr. Greg Schroeder <br />Mrs. Kathy Glanzer <br />MINUTES Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 96-10-246 - APPROVING TAE MINUTES OF TFiE <br />SEPTEMBER 25, 1996 WORKSHOP COUNCIL MEETING, THE <br />SEPTEMBER 25, 1996 REGULAR COUNCIL MEETING, AND T$E <br />SEPTEMBER 25, 1996 CLOSED COUNCIL MEETING AS SUBMITTED <br />The foregoing resolution was duly seconded by LaValle. <br />GROUP HOME - Mayor Fahey acknowledged the many residents present <br />3019 THUNDER this evening to discuss the group home to be located <br />BAY ROAD at 3019 Thunder Bay Road. Fahey reported that in the <br />1980's the State Legislature passed a Statute which <br />made group homes of six or fewer residents a permitted <br />use in a residential area. About that same time, <br />Little Canada was approached with a group home <br />proposal. Because of the opposition of the residents <br />in the area, the City Council denied the group home <br />request. The applicant took the matter to Court, and <br />the Court upheld the State Law which basically says <br />cities have no licensing authority or means to preclude <br />a group home. Therefore, Little Canada has no ability <br />to deny the home proposed for Thunder Bay Road. <br />
