MINUTES <br />CITY COUNCIL <br />OCTOBER 9, 1996 <br />Licensing of group homes is a function of either the <br />State or the County. Fahey wanted those present to <br />understand that the only authority the City has is to <br />ensure the home meets City Code requirements. <br />Stephanie Jensen reported that she would speak on <br />behalf of the neighbors in the proximity of 3019 <br />Thunder Bay Road. Jensen read a prepared statement <br />dated October 8, 1996 which outlined the concerns and <br />questions residents have with the proposal. These <br />centered on the safety of small children in the <br />neighborhood, the upkeep of the property at 3019 <br />Thunder Bay Road, and the re-salability of homes in the <br />area. <br />Fahey again pointed out that State Law has not changed <br />since the 1980's, and the only authority Little Canada <br />has is to ensure Codes are met. Minnesota Statues <br />provide that residential programs of 6 or fewer persons <br />are considered a single-family permitted use. The <br />Court has said cities have no power or authority in <br />these situations unless there are Code violations. <br />Fahey indicated that the City will be very sensitive to <br />Code violations and will make inspections, but the <br />State and/or County has the licensing authority. <br />Martin McGraw appeared before the Council and reported <br />that he has purchased the property at 3019 Thunder Bay <br />Road so he can lease it to AME Community Services, Inc. <br />AME will be using the home to provide residential <br />placement to four adults who have Prader-Willi <br />Syndrome. McGraw reported that the only modifications <br />which have been made to the home is the addition of a <br />second bathroom. With regard to concern about safety <br />of children in the area, McGraw reported that these <br />people are currently living in communities with their <br />families. They are in no way a danger to any children, <br />and are often times very sedate. These people must be <br />encouraged by staff to get out into the community. The <br />residents will be supervised 24 hours per day for their <br />own protection since they are vulnerable adults. <br />McGraw reported that the group home meets all Code <br />requirements as well as has the appropriate licenses. <br />Jensen asked if the residents pay rent. <br />McGraw replied that the residents are required to pay <br />room and board. <br />Jensen felt she should have more say in where a group <br />2 <br />
