MINUTES <br />CITY COUNCIL <br />OCTOBER 9, 1996 <br />Fahey pointed out that the City has no power to <br />preclude the group home. The only control the City has <br />is with code enforcement issues. If the group home <br />does not meets code and becomes a public nuisance, then <br />the City would have the ability to abate the nuisance. <br />The City Administrator reported that Ramsey County has <br />informed the City that the home is being set up in <br />accordance with the law. The proper applications have <br />been made and are pending. Once the County's review <br />process is completed, the County will make a <br />recommendation on the licensing issue to the Department <br />of Human Services. <br />The Administrator noted that concern had been expressed <br />about remodeling which occurred at the group home <br />without a building permit. The Building Inspector has <br />reviewed the situation, and confirmed that a roughed-in <br />bathroom was completed. Since the bathroom had already <br />been roughed-in, no building permit was required. <br />Electrical work was done to hard-wire additional smoke <br />detectors, and the necessary electrical permit was <br />taken out for this work. <br />The Administrator further reported that City staff has <br />put together a reference list which gives phone numbers <br />of contacts for Ramsey County Licensing, AME <br />Corporation, the City's Code Enforcement Officer. This <br />list is available to the neighborhood. With regard to <br />the City's legal abilities in this group home issue, <br />the Administrator noted that the City has no licensing <br />authority, but will ensure all City Code requirements <br />are met. <br />A member of the neighborhood pointed out the entire <br />neighborhood is not on one side of the issue. This <br />gentleman stated that he was glad for the information <br />that the group home would not decrease property values <br />nor is it required that the existence of the group home <br />would have to be disclosed to a potential buyer. While <br />there was concern expressed about the different types <br />of group homes, this resident felt there would be <br />different licensing requirements depending on the type <br />of group home proposed. <br />The Administrator indicated that anyone interested in <br />getting a copy of the U of M study regarding group <br />homes' effect on property values, can obtain a copy <br />from City staff. <br />A member of the audience asked about the types of <br />6 <br />
