MINUTES <br />CITY COUNCIL <br />OCTOBER 23, 1996 <br />FILL <br />PERMIT <br />BOB'S CYCLE <br />VARIANCE - <br />BELLAND <br />AUTO REPAIR <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (3) Fahey, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Mr. Fahey introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 96-10-273 - APPROVING THE FILL PERMIT <br />FOR BOB'S CYCLE AS REQUESTED BASED ON THE <br />RECOMMENDATION OF THE CITY ENGINEER AND PUBLIC WORKS <br />DIRECTOR <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (3) Fahey, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Council reviewed the request from Steve Trudeau, <br />Kraus Anderson, representing Belland Auto, to table <br />action on Belland's request for a rear yard setback <br />variance until December, 1996. The Belland's are <br />currently negotiating for the purchase of the adjacent <br />property. Should that purchase proceed, it may not be <br />necessary to proceed with the variance request. <br />The City Attorney recommended the City request a letter <br />from Belland's waiving their rights under the Statute <br />with regard to the 60-day review period required of the <br />City. Upon receipt of that letter, the matter can be <br />tabled until December. Without the letter, the Council <br />should move to deny the variance given that the City's <br />60-day review period will lapse early in November. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 96-10-274 - TABLING ACTION ON TAE <br />BELLAND APPLICATION FOR REAR YARD SETBACK VARIANCE <br />UNTIL THE DECEMBER 18, 1996 REGULAR COUNCIL MEETING <br />CONTINGENT UPON RECEIPT OF A LETTER FROM BELLAND AUTO <br />REPAIR FORMALIZING THAT REQUEST AND WAIVING THE CITY OF <br />THE 60-DAY REVIEW PERIOD, AND INDICATING THAT WITHOUT <br />THE WRITTEN REQUEST FROM BELLAND AUTO REPAIR, THE <br />VARIANCE REQUEST WILL BE HEREBY DENIED <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (3) Fahey, Scalze, Pedersen. <br />Nays (0).
