MINUTE5 <br />CITY COUNCIL <br />OCTOBER 23, 1996 <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (3) LaValle, Pedersen, Fahey. <br />Nays (1) Scalze. Resolution failed. <br />PUBLIC Fahey opened the public hearing to consider the <br />HEARINGS- application submitted by Richard Thorp, 470 Costa Lane, <br />SPECIAL for a special use permit for a home occupation, as well <br />USE PERMIT as opened the public hearing to consider the appeal <br />FOR HOME filed by Richard Thorp of the Council's denial of his <br />OCCUPATION request for a variance allowing the encroachment of an <br />& APPEAL OF accessory building into the required front yard setback <br />VARIANCE on a corner lot. It was noted that the Planning <br />DENIAL - Commission has recommended approval of the special use <br />470 COSTA permit. However, the Planning Commission has <br />LANE - THORP recommended denial of the variance appeal. <br /> Scalze pointed out that City Code would not allow the <br /> storage of any equipment in the shed which is <br /> associated with the home occupation. <br /> Thorp replied he was aware of that. <br /> Fahey suggested approval of the special use permit for <br /> the home occupation should be subject to removal of the <br /> encroaching accessory building. <br /> LaValle asked the type of equipment Thorp has for his <br /> home occupation. <br />Thorp replied that he has a pick-up truck and mowers. <br />This equipment would be stored in his garage. The <br />purpose of the shed is for the storage of his kids <br />toys. <br />Fahey felt that the shed needed to be relocated to the <br />back yard where required setbacks can be met. Fahey <br />felt that a variance could not be granted since it <br />would grant a privilege to Thorp that other citizens in <br />the City do not enjoy. Fahey felt the special use <br />permit for the home occupation could be accommodated, <br />provided the shed is relocated. <br />Thorp reported that he has a petition signed by his <br />neighbors indicating they do not oppose the variance <br />request. Thorp reported that he has driven around <br />Little Canada, and has located numerous sheds which <br />violate required setbacks. <br />Scalze asked Thorp how he verified property lines and <br />determined these sheds were within the setback. <br />3 <br />
