MINUTES <br />CITY COUNCIL <br />DECEMBER 18~ 1996 <br />Konick stated that without considering public safety <br />issues, the City is not doing a service to the <br />residents of the park. <br />Pedersen asked if the Statutes would apply to new <br />mobile homes only. <br />The City Planner reported that adoption of State <br />Statutes does not require the City to retro-actively <br />enforce the ordinance. <br />Fahey pointed out that currently most of the mobile <br />homes in the City are non-conforminq uses. If the City <br />adopts State Statutes and ten new mobile homes are <br />brought in, those homes will have to comply with the <br />provisions of the Statute. If there is a problem with <br />a provision of the Statute, Fahey felt the remedy was <br />to get the State to amend the statute. Fahey stated <br />that he was not convinced there was a public safety <br />hazard given that the City is accepting the mobile home <br />parks as they currently exist. <br />Pedersen pointed out that it is when the mobile home <br />parks make changes that they will be required to comply <br />with the new ordinance. Pedersen pointed out that it <br />may be necessary to position the mobile home somewhat <br />differently in order to meet setback requirements. <br />Konick responded that he would suspect that rather than <br />reposition the home, residents will be forced to park <br />on the street. <br />The City Administrator reported that there has been a <br />lack of enforcement of State Statutes regulating mobile <br />home parks. The County is currently responsible for <br />enforcing these Statutes. Joe Hibbard of the County <br />has indicated that they will enforce the Statute for <br />any homes which moved into the parks after January 1, <br />1993. This is the date that the County took <br />responsibility for enforcement. The Administrator <br />reported that he discussed the 10 foot separation from <br />parking areas with Hibbard, who indicated it was one <br />that should be looked at. The Administrator reported <br />that over the last four months, four mobile homes have <br />been moved into the City and all have complied with <br />State Statute requirements. <br />Fahey suggested that perhaps City staff could write to <br />the City~s Legislators and ask that this provision in <br />the Statute be reviewed. <br />10 <br />
