MINUTES <br />CITY COUNCIL <br />DECEMBER 18~ 1996 <br />TO MOBILE home parks. Fahey pointed out that most of the mobile <br />HOME PARKS home park property within the City is non-conforming. <br />This amendment would allow for improvements and <br />upgrades within the mobile home parks provided that <br />State Statutes are met. <br />John Konick, representing North Star Estates Mobile <br />Home Park, reported that one part of the ordinance was <br />particularly troublesome. That is the requirement for <br />a 10 foot separation from a mobile home to parking <br />area. Konick reported that North Star Estates has off- <br />street parking since the park was constructed in 1970. <br />Approximately 90% of the units in the park could not <br />comply with the requirement for 10 feet between home <br />and parking area. The consequence will be that <br />residents will have to park on the street. Konick felt <br />that from a health and safety perspective this was a <br />negative since it would make access by emergency <br />vehicles very difficult. <br />Konick reported that from North Star Estates' <br />perspective, there are two issues. First, is the State <br />Statute with regard to the parking separation has never <br />been enforced. If the City adopts the proposed <br />ordinance, will the City begin enforcing this <br />provision. Konick felt the State did not enforce this <br />provision because it realizes it will cause health and <br />safety concerns. Konick also reported that in <br />considering the ordinance, the Planning Commission did <br />not consider the health and safety issues, and Konick <br />did not believe City staff gave these issues any <br />consideration as well. <br />Fahey suggested the City should not be adopting a State <br />Statute which the State does not enforce. Fahey felt <br />it was misleading for the State to keep such a Statute <br />on the booke since cities would assume the provisions <br />of the Statute are being enforced. Fahey pointed out <br />that the County does annual inspections of mobile home <br />parks. <br />Konick felt it was not good public policy to adopt an <br />ordinance which is not enforced, and suggested this <br />issue be raised with the State. <br />Fahey pointed out that the option is for the City to <br />adopt the State Statutes. If the State decides to <br />change their requirements, the City can always amend <br />its ordinance. Fahey pointed out that the Statutes <br />would be applied to any new mobile homes which are <br />moved into the City. <br />9 <br />
