MINUTES <br />CITY COUNCIL <br />JANUARY 8~ 1997 <br />PUBLIC <br />HEARING - <br />OF MCDONOUGH <br />PROPERTY <br />hearing was closed. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 97-1-2 - VACATING THE ROAD RIGHT-OF-WAY <br />FOR THE PORTION OF EAST ROSE PLACE WHICH IS NOT IN ITS <br />PROPER LOCATION AS RECOMMENDED BY THE CITY <br />ADMINISTRATOR, AND ACCEPTING THE EASEMENT FOR EAST ROSE <br />PLACE FOR THE CORRECTED LOCATION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Morelan, Pedersen, Fahey. <br />Nays (0). Resolution declared adopted. <br />The Administrative Assistant reported that as part o£ <br />the original dedication of this portion of East Rose <br />Place, a 30-foot strip of land just south of road <br />easement was conveyed to the City. This strip would <br />have been cut off from the balance of the Engebretson <br />property at the time the road easement was conveyed, <br />therefore, would have been of no use to the property <br />owner. Given that the road easement was conveyed in an <br />incorrect location, this 30-foot strip was also <br />conveyed incorrectly and is located through the <br />property at 154 East County Road C. Therefore, it is <br />the recommendation that the strip be conveyed to the <br />property owner at 154 East County Road C to clear up <br />the title of this lot. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 97-1-3 - AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE THE QUIT CLAIM DEED CONVEYING <br />A 30-FOOT STRIP OF LAND TO THE PROPERTY OWNERS OF 154 <br />EAST COUNTY ROAD C AS RECOMMENDED BY THE CITY ATTORNEY <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) Morelan, Pedersen, Fahey, Scalze, LaValle. <br />Nays (0). Resolution declared adopted. <br />The Mayor opened the Public Hearing to consider the <br />reassessment of the McDonough property located at <br />164 Lake Street for costs associated with the <br />improvement of Lake Street. <br />The City Attorney pointed out that the reassessment of <br />this parcel is by order of the court with the specific <br />assessment amount set by the court.
