MINUTES <br />CITY COUNCIL <br />FEBRUARY 12, 1997 <br />Weavers reported that the new ordinance must be adopted <br />by both the Cities of Little Canada and Maplewood given <br />that Gervais Lake lies in both cities. The ordinance <br />will also need to be approved by the DNR. Weavers <br />reported that the DNR has already reviewed the proposed <br />ordinance and has made some modifications to it. <br />Weavers reported that the proposed ordinance is <br />specific to Lake Gervais and does not address issues on <br />other lakes within the City. <br />Weavers reported that the existing ordinance provides <br />for a no wake zone extending 300 feet from shore. The <br />DNR does not allow for a no wake zone this large, and <br />the proposed ordinance has changed that zone to 150 <br />feet. The ordinance also changes the definition of <br />high water level when no wake is allowed on the entire <br />lake. That level is proposed at 860 feet. Weavers <br />reported that the dam at the outlet of Keller is at 858 <br />feet, therefore, the lake would have to rise by 2 feet <br />for the no wake provision to take effect. Weavers <br />estimated that Gervais has reached the 860 level <br />approximately 3 or 4 times in the last 15 years. If <br />the 860 level is reached, the City will need to <br />announce the no wake restriction by published notice <br />and by posting the notice at the public boat landing on <br />Spoon Lake. weavers reported that the Homeowners <br />Association is willing to do the necessary posting. <br />The ordinance also provides some speed regulations in <br />areas where there are skating rinks on the lake. <br />Morelan asked for additional information about the <br />Gervais Lake Homeowners Association. <br />Mugs Nardini, President of the Association, reported <br />that there are approximately 100 property owners on the <br />lake. The Association has 52 paid members, and all <br />Gervais Lake property owners are welcome to join the <br />Association. Of the 52 paid members, approximately 7 <br />are Maplewood residents. <br />Nardini reported that the Association is also working <br />with the County and Watershed on the milfoil issue. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 97-2-33 - ADOPTING CHAPTER 1301, AN <br />ORDINANCE REGULATING THE SURFACE USE OF LAKE GERVAIS <br />3 <br />
