MINUTES <br />CITY COUNCIL <br />FEBRUARY 26~ 1997 <br />LaValle asked how other cities address equipment <br />removal. <br />The City Administrator reported that the Bloomington <br />Ordinance provides for assessment of costs against the <br />property owner. The Administrator felt there may be <br />difficulties in assessing costs should the property <br />owner contest the assessment and the City had to prove <br />benefits received. With the nuisance statute, costs <br />would become a lien on the property which are not <br />collected until such time as a property is sold. The <br />Administrator felt tracking a bond or letter of credit <br />annually was preferable to the City getting involved in <br />these other proceedings. Assessments and liens would <br />not be recoverable by the City for a period of time. <br />LaValle suggested the matter be tabled until staff <br />determines how surrounding cities are addressing this <br />issue. <br />Scalze felt using Statutes to collect for tower removal <br />costs was more feasible on a highly valued piece of <br />property than it was on a marginal piece of property. <br />Morelan suggested the Council pass the ordinance before <br />it this evening. If further research reveals that <br />tower removal should be addressed in another way, the <br />ordinance can be amended at a later date. This would <br />allow the City to remove the moratorium on the <br />construction of antennas and towers. <br />Runkel suggested his attorneys meet with the City <br />Attorney to discuss Sprint's position. Perhaps a <br />mutually-agreeable ordinance can be worked out. <br />Scalze indicated she was not interested in spending <br />City Attorney time to meet with industry attorneys. <br />Scalze stated that she has no problem with the <br />ordinance as presented, but would like additional <br />information on how neighboring cities address the tower <br />removal issue. <br />Morelan suggested staff also get some estimates of <br />costs for removing a tower and bond/letter of credit <br />amounts.
