Many existing parking areas in North Star Estates do not <br />comply with the setback requirement, and there is no provision for <br />grandfathering in existing situations. <br />The Administrator pointed out that the variance has only been applied for <br />at the County level, not at the City level. At the public hearing the <br />Administrator had pointed out that even if the County approves a variance, <br />the request would have to be acted on by the City as well. The <br />Administrator reported that there are concerns from a life safety and <br />emer~ency vehicle access standpoint with the variance request in that the <br />request contains no distance separatin~ parkin~ from the adjacent <br />mobilehome. <br />The Administrator reported that at the public hearing North Star Estates <br />indicated if the parking setback was enforced, it would force North Star <br />Estates' residents to park on the street. The Administrator reported that he <br />indicated at the hearing he was not sure on-street parking was allowed in <br />the mobilehome park, and the City would generally be opposed because of <br />life safety concerns. <br />The Administrator further reported that at the hearing he indicated should <br />the State change its Statute re~arding the parking separation requirement, <br />the City would be willing to chan~e its ordinance as we1L The <br />Administrator asked the Council to either take an official position in <br />support of the comments he made at the County's public hearing, or <br />amend them as they deem appropriate. <br />Fahey asked if it was North Star Estates' position that the City had no <br />need to act on a variance since enforcement responsibilities had been <br />deferred to the County. <br />Morelan pointed out that variance procedures are included in the City's <br />Zoning Code. The City Attorney replied that was correct. <br />Scalze questioned the basis for the variance rec~uest; specifically why is <br />North Star Estates' situation unique? <br />The City Administrator replied that there are many mobilehome parks in <br />the State with the same problem. However, North Star Estates is the only <br />mobilehome park to have made application for a variance. The <br />Administrator pointed out the previous discussion the Council had on the <br />rational for the 10-f'oot setback requirement. At the time of that discussion <br />the issue was deferred to the City's legislators to try and determine the <br />State's rational for the 10-foot setback. That answer has not been <br />
