The separation only applies to the <br />plrking pad and the neighbor's mobilehome. Konek stated that it could be <br />just as dan~erous to park 1 vehicle next to your own mobilehome as it is to <br />the neighbor's mobilehome. <br />Scalze asked what prompted North Star Estates to apply for the variance. <br />Konek replied that North Star Estates wants to comply with the law. The <br />law says the only way there can be compliance is if a variance is applied <br />for. IZonek stated that Nortl~ Star Estates wants to continue operating just <br />the way it has always operated. <br />Scal-ce asked if the intent is to move more double-wides into t6e park <br />prompting the variance request. <br />Fahey pointed out that the City has asked the State for a interpretation on <br />why this provision in the Statute was created and has suggested that the <br />State either enforce it or change it. Fahey felt the North Star Estates <br />variance request was made at this time prior to the State's enforcement of <br />the provision. <br />Morelan pointed out that North Star's variance request makes reference to <br />a section of City Code which does not exist. The City's Code contains a <br />gr~ndfather clause and atte~npted to address the issue of double-wide <br />mobilehomes replacing single-wides. <br />Konek reported that the City Administrator informed NoRh Star Estates <br />that they would have to apply for a variance from the City even if the <br />County grants the variance. I<onek reported that he does not a~ree with <br />that position, but that is an issue for another day. <br />Konek stated that the test is whether North Star Estates is entitled to a <br />variance from the State Commissioner of Health, which has delegaYed this <br />authority to the County, and whether the residents' welfare or safety will <br />be affected if the variance is approved. Konek stated that Nortli Star <br />Estates' positiou is th~t tlie health, safety, and welfare of residents will not <br />be endangered if the variance is granted. The mobilehome park has <br />existed since 1971 and there have been no problems. Cars have been <br />parked adjacent to mobilehomes since that time, and there is no evidence <br />of problems to anyone. Konek indicated that if the variance is not <br />approved, residents will be forced to park out on the street which will be a <br />
