MINUT~S <br />CITY COUNC[L <br />APRIL 16, 1997 <br />were actually trailers which were designed to be pulled by cars. These <br />trailers were not constructed to meet 1ny fire codes. Today all new <br />mobilehomes are constructed according to very precise fire safety <br />standards. Konek felt these mobilehomes were as safe or safer than <br />single-family homes. Single-family homes are allowed to have attached <br />garages which brings vehicles within inches of homes. However, State <br />Statutes says that a neighbo~'s vehicles cannot be parlced within 10 feet of <br />a mobilehome. <br />Fahey agreed that perhaps the standard should be closer than 10 feet. <br />Fahey pointed out that he did not believe the County had the authority to <br />grant a variance to the City's Code. Fahey noted that the City <br />Administrator has already stated the City's position is that guidance <br />should be provided at the State level, and the County should not grant a <br />vlriance leaving unresolved the State's addressing the entire issue. <br />Guidance 1nd direction sltould be provided by the State. Fahey stated that <br />he did not believe the City would be bound by a variance granted by the <br />County. Fahey indicated that the CiYy Council sliould ratify the City <br />Administrator's recommendation and request that the County work with <br />the State. <br />The City Administrator felt this is where the City has been with the issue <br />all alon~; - the State should look at it and resolve it. <br />Fahey acknowledged that tenants do not want to be displaced, and it <br />doesn't seem that granting a variance will ensure this. <br />Morelan agreed Yhe 10 foot separation may i~ot make sense. However, the <br />issue is a County-wide 1nd State-wide issue. The City will not support the <br />variance, and the issue must be resolved. It makes no sense to displace <br />residents. <br />Fahey stated that granting the variance should not ~ive NorCh Star Estates <br />privileges that others do not enjoy. Fahey felt there must be another <br />approach to resolving the situation. <br />Konek pointed out that Nortl~ Star Estates in the only mobilehome park in <br />Little Canada with this particular situation. <br />Fahey pointed out the variance will give North Star Estates privileges <br />other mobilehome park owners in the County do not enjoy. The variance <br />should not be granted unless the State is prepared to chan~e the Statute. <br />Fahey felt a change in the StaYute was tl~e better way to address the <br />situation. <br />
