MINUTES <br />CITY COUNCIL <br />APRIL 23, 1997 <br />The Pllnner indicated that the Mayor's comments regarding the ordinance <br />were correct. However, there are three prope~~ty owners who must <br />participate in the road improvement. It is obvious that the property owner <br />abutting South Owasso Blvd. will not participate and that a road <br />improvement would negatively impact this property. <br />Fahey felt if the road is not improved and Donovan and/or Roseville <br />Plumbin~ want to expand, they should look for another site that would <br />allow for expansion. Fahey felt the existin~ use of these properties was <br />fine as non-conformin~ uses. However, nothing has changed since 1987 <br />which would cause the Council to change its position on this matter. <br />Fahey felt the issue was the ability of landowners to comply with existng <br />City standards. <br />Shamp indicated that there is no problem with improving a road on the <br />west side of the Donovan propeity. The problem is the effect this road <br />will have on the property to the south. Donovan has no control over that <br />propeity. <br />Morelan suggested that Donovan Constructio~~ and Roseville Plumbing get <br />together with the property owner on the south and discuss the matter. It <br />may mean that Donovan and Roseville Plumbing may have to purchase <br />this property. <br />Shamp pointed out that there are three property owners involved in this <br />situation all of whom have diff'erent perspectives on it. <br />Morelau felt resolution of this matter must come from the properYy <br />owners. <br />Fahey pointed ouY Yhat there is no public purpose for the City to put this <br />road in. The road would be access for ponovan and Roseville Plumbing. <br />Shamp felt that given the impasse tl~e road would not be constructed for <br />anotlier ten years. Shamp indicated that a 60-foot, 9-ton sYreeY was not <br />necessary to provide access to t6e northern properties. Shamp felt the <br />situation would puslt Donovan Construction out of Little Canada. Shamp <br />pointed out that the property is hidden and there is a hodge podge of <br />development around it. Shamp asked if there was any flexibility in the <br />size of street which would need to be constructed. <br />The Planner pointed out t6at pavement would not be 60 feet in width, but <br />rather 38 to 44 feet. it was sug~ested thlt perltaps the right-of-way could <br />be narrower than 60 feet provided there was enough room for the utilities <br />within the right-of-way.
