MINUTES <br />CITY COUNCIL <br />APRIL 23, 1997 <br />received in 1987 was fair pointing out that the City could have required <br />the road and put iY in. <br />Shamp asked why that wasn't done. <br />Fahey replied that the City did not f'orce the road because Donovan <br />Construction and Roseville Plumbin~ did not want to pay for it. The City <br />informed them that at tl~e Time they wanted to expand their buildins~s, the <br />road would be put in. <br />Shamp pointed out that the property owner on the corner doesn't want to <br />give up his property Co the road. <br />Fahey suggested that Tonight's focus be the re~uest for extension of the <br />CU~P since the road issue will noY be resolved tonight. <br />Sl~amp again indicated that the trailer will be removed since Donovan has <br />leased some off'ice s}~ace. Shamp wanted some indication from the <br />Council on the road issue. <br />Fahey reported that he was opposed to the City Planne~'s suggestion that <br />expansion of the Donovan building be allowed with continued access via <br />the easement. Fahey felt it w1s a matter of principal and asked how the <br />Council would deal with simitar requests from property owners wanting to <br />expand non-conforming uses. ff the Council wants to follow the Planner's <br />recommendation, theu the Ordinance should be amended to offer the same <br />rights to every property owner. <br />Shamp indicated that Donovan wants some long-term direction on the <br />issue of a permit Yo improve their property. <br />Scalze pointed out that tlte Couucil made the decision in 1987. That <br />decision was that tl~e businesses could not be expanded until the road <br />improvement was made. <br />Shamp pointed out that this decision adversely impacts the property to the <br />south. Sl~amp asked what flexibility there is given this impact. <br />Fahey felt tlie ordina~~ce w1s clear, there must be access to an improved <br />street. Tahey asked what blsis tl~ere was for waivins~ this requirement, and <br />felt it was not a variance situation. The ordinance stated that non- <br />conformin~ uses cannot be expanded. Fahey felt that unless the Council <br />wanted to change tlte ordinance, the street would be required before <br />Donovan and Roseville Pl~imbing are allowed to expand. <br />l4 <br />
