STAFF <br />REPORT <br />TO:Mayor Fischer and Members of City Council <br />FROM:Heidi Heller, City Clerk/HR Manager <br />DATE:May 14, 2025 <br />RE:Amend City Code Chapter 1701, Tree Management <br />ACTION TO BE CONSIDERED: <br />Adopt Ordinance 913, Amending City Code Chapter 1701, Tree Management: Nuisance, <br />Disease and Insect Control. <br />BACKGROUND: <br />In August 2022, City Code Chapter 1701 was completely updated to better address the growing <br />issues with tree diseases and removal of dead trees throughout the city. As city staff has been <br />responding to more complaints from residents about dead trees and requiring property owners to <br />remove dead or dying trees that are at risk of falling on structures or people, Chapter 1701 has <br />been utilized more. Staff recently noticed that the violation section incorrectly includes the word <br />“not.” Staff recommends amending this chapter to remove this single word so that it is a <br />violation of the chapter to fail to remove the nuisance. <br />1701.100. VIOLATION. Failure of any owner or person in control of private property to <br />abate or eliminate on such property a nuisance, as defined in this chapter, shall not constitute a <br />violation of this chapter. <br />RECOMMENDATION: <br />Adopt Ordinance 913, Amending City Code Chapter 1701.100, Tree Management Violation
