MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 1997 <br />The City Engineer reported that the adjacent Maplewood resident was <br />adamant about how the intersection shouid be constructed. <br />Pedersen pointed out that the intersection is totally within street right-of- <br />way, and not on the Maplewood resident's property. The Engineer stated <br />that that was correct. <br />Pedersen felt that the design of the intersection needed to make sense from <br />a public safety standpoint. Fahey felt the intersection was poorly designed <br />the way it is now. Morelan pointed out that the design in the plans and <br />specs is a~ood one; the intersection was poorly constructed. <br />Pedersen and Fahey questioned the staking of the intersection and whether <br />the stakes were tampered with. The City En~ineer replied that there are a <br />few options as to what happened. Bonestroo's surveyor has indicated that <br />he was influenced by the adjoining property owner as to where to place <br />the stakes. <br />Scalze asked who paid the surveyor. The City Engineer reported that he is <br />an employee of Bonestroo and the City pays Bonestroo. Morelan <br />questioned how a surveyor could be influenced when staking a project. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOI,UTIONNO. 97-11-275 - DECLARING THAT THE CITY <br />PURSUE THE CORRECTION OF THE ARCADE STREET/KEI,I,ER <br />PARKWAY INTERSECTION AS PER PI.ANS AND <br />SPECIFICATIONS AND AUTHORIZING THE CITY <br />ADMINISTRATOR AND CITY ENCINEER TO MEET WITH THE <br />CITY OF MAPI,EWOOD .STAFF AND/OR CITY COUNCIL TO TRY <br />AND REACHAGREEMENT TO CORRECTION THE <br />INTERSECTION TO COMPI,Y WITH THAT DESIGN <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Fahey, Scalze, LaValle, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />The Council and City Administrator discussed the approach the City <br />would take in this issue, and it was felt that the City Administrator should <br />first pursue the issue with the Maplewood City Mana~er and City <br />Engineer. If necessary, the matter should be brought to the Maplewood <br />City Council. It was pointed out that this is an issue of public safety and <br />should be pursued as such. The Administrator indicated that his thought is <br />to have the Cable TV Producer prepare a video of the intersection to <br />demonstrate the public safety issue the existing design creates. <br />
