MINUTES CITY COUNCIL NOVEMBER 12, 1997 The City Engineer reported that the adjacent Maplewood resident was adamant about how the intersection shouid be constructed. Pedersen pointed out that the intersection is totally within street right-of- way, and not on the Maplewood resident's property. The Engineer stated that that was correct. Pedersen felt that the design of the intersection needed to make sense from a public safety standpoint. Fahey felt the intersection was poorly designed the way it is now. Morelan pointed out that the design in the plans and specs is a~ood one; the intersection was poorly constructed. Pedersen and Fahey questioned the staking of the intersection and whether the stakes were tampered with. The City En~ineer replied that there are a few options as to what happened. Bonestroo's surveyor has indicated that he was influenced by the adjoining property owner as to where to place the stakes. Scalze asked who paid the surveyor. The City Engineer reported that he is an employee of Bonestroo and the City pays Bonestroo. Morelan questioned how a surveyor could be influenced when staking a project. Mr. Fahey introduced the following resolution and moved its adoption: RESOI,UTIONNO. 97-11-275 - DECLARING THAT THE CITY PURSUE THE CORRECTION OF THE ARCADE STREET/KEI,I,ER PARKWAY INTERSECTION AS PER PI.ANS AND SPECIFICATIONS AND AUTHORIZING THE CITY ADMINISTRATOR AND CITY ENCINEER TO MEET WITH THE CITY OF MAPI,EWOOD .STAFF AND/OR CITY COUNCIL TO TRY AND REACHAGREEMENT TO CORRECTION THE INTERSECTION TO COMPI,Y WITH THAT DESIGN The foregoing resolution was duly seconded by Scalze. Ayes (5) Fahey, Scalze, LaValle, Pedersen, Morelan. Nays (0). Resolution declared adopted. The Council and City Administrator discussed the approach the City would take in this issue, and it was felt that the City Administrator should first pursue the issue with the Maplewood City Mana~er and City Engineer. If necessary, the matter should be brought to the Maplewood City Council. It was pointed out that this is an issue of public safety and should be pursued as such. The Administrator indicated that his thought is to have the Cable TV Producer prepare a video of the intersection to demonstrate the public safety issue the existing design creates.
