MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 1997 <br />New Year's Day. The Attorney anticipated that the matter may be <br />resolved by April of 1998. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RE.SOL UTION NO. 97-11-274 - INSTRUCTING THE CITY <br />ADMINISTRATOR TO SEND A LETTER TO OFF-SALE LIQUOR <br />LICENSE HOLDERS, AS WEI,L AS THE R,9MSEY COUNTY <br />SHERIFF'S DEPARTMENT, INFORMING THEM THAT THE CITY <br />DOES NOT INTEND TO ENFORCE ITS ORDINANCE WITH <br />RECARD TO OFF-SAI,E I,IQUOR .SALES ON NEW YEAR'S DAY, <br />1998 <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Fahey, Morelan, Pedersen. <br />Nays (0). Resolution declared adopted. <br />ARTICLE Scalze informed the Council of a recent article in the League of Minnesota <br />IN LEAGUE Cities Bulletin which use the SuperAmerica versus City of Little Canada <br />BULLETIN litigation as a good example of the City Council's use of public testimony <br />and sentiment in supporting their action. <br />ARCADE/ The City Engineer appeared before the Council and described a diagram <br />KELLER comparing the actual construction of the Arcade Street/Keller Parkway <br />PARKWAY intersection with what was shown on the plans and specifications for the <br />INTERSECTION project, as well as what the Maplewood City Engineer has agreed to bring <br />the intersection closer into compliance with plans and specs. The City <br />Engineer reported that the Maplewood City Engineer, Ken Haider, is <br />willing to see the width of Arcade Street at the intersection expanded to 36 <br />feet. Haider has indicated that any more than this would have to go to the <br />Maplewood City Council for approval. The City Engineer recommended <br />that the matter be brought to the Maplewood City Council seeking their <br />agreement to bring that intersection to what is shown on plans and specs. <br />Morelan asked if the design shown on the plans and specs had been agreed <br />to by the City of Maplewood. The City Engineer replied that it had. <br />Morelan asked if Haider disputed this fact. The City Engineer replied that <br />Haider did not. <br />The City Engineer reported that during construction of the project he met <br />with Haider. There was some confusion at that time about the staking of <br />the intersection and what was a~reed to during construction. <br />Pedersen questioned why there should be confusion if there were plans <br />and specs for the intersection. <br />6 <br />
