MINUTES CITY COUNCIL DECEMBER 17, 1997 The foregoing resolution was duty seconded by Scalze. Ayes (5) Morelan, Scalze, Pedersen, LaValle, Fahey. Nays (0). Resolution declared adopted. SPOON/ The Council discussed the request of the Gervais Lake Homeowners GERVAIS Association for City support of their request to have representation LAKE on the Spoon/Gervais Lake Bridge Desi~n Committee. It was noted BRIDGE that the Council has appointed Claudia Drabik as the City's representative on that Committee and Karen Johnson as alternate. The City Administrator reported that St. Paul Public Art is coordinating the process, and suggested that the process is not that formal so there may be no objection to another entity having representation on the Committee. Mr. Pedersen introduced the following resolution and moved its adoption: RE.SOI, UTION NO. 97-12-310 - AUTHORIZING THE CITY ADMINISTRATOR TO CONTACT ST. PAUL PU73LICART AND INDICATE THE CITY'S SUPPORT OF THE LAKE GERVAIS HOMEOWNERS' ASSOCIATION REQUEST FOR REPRESENTATION ON THE SPOON/GERVAIS I.AKE 13RIDGE DESIGN COMMITTEE The foregoing resolution was duly seconded by Scalze. DOMINIUM The City Administrator reported he has not yet received the agreement AGREEMENT from Dominium relative to The Provinces tax credit issue. We have submitted revisions to Dominium's draft. One provision included relates to Dominium's agreement not to apply for 4(d) class rate status for property tax purposes on the property. The City Administrator noted this was not contemplated at the time of our discussion with them as it had not yet been enacted by the Legis(ature. This new class rate creates additional cash flow to the project not presently accounted for. This could allow us to revisit the sprinkler issue given this new source of funds. The City Administrator also noted that Dominium will need us to issue a 42M letter or they can claim Title II tax credits. Therefore, we have some leverage relative to timin~.
