MINUTES CITY COUNCIL JANUARY 28, 1998 Mr. LaValle introduced the following resolution and moved its adoption: RE,SOI, UTIDN NO. 98-1-I4 - TA73LING ACTION ON THE AMENDMENT TO ZONING ORDIANNCE REQUESTED 73Y MASTERPIECE HOMES ALLOWING OFF-PREMISE SIGNS TO ]3E I.OCATED IN THE PU737.IC RIGHT-OF-WAY PENDING A RECOMMENDATION I3Y THE PLANNING COMMISSION The foregoin~ resolution was duly seconded by Morelan. Ayes (5) LaValle, Morelan, Scalze, Fahey, Pedersen. Nays (0). Resolution declared adopted. FINAL PLAT Mayor Fahey opened the public hearing to consider the Final Plat for & FINAL PUD- the Herita~e Office Park 3"~ Addition as well as Final Planned Unit HERITAGE Development a(lowing more than one owner-occupied office building OFF'ICE on a lot. The Planning Commission recommended approval subject to PARK 3RD compliance with the recommendations listed in their meeting minutes ADDITION dated January 8, 1998. There was no one from the general public present wishing to comment on this matter. Upon motion by Fahey, seconded by LaValle, the public hearing was closed. John Dobbs, Heritage Development, reported that he has reviewed the City Administrator's recommendation relative to park charges and is agreeable to this recommendation. Dobbs further reported that at the Planning Commission meeting, the issue of screening fi•om a future land use on the property to the east was discussed as well as access by fire trucks to the office buildings. Dobbs reported that Heritage has discussed the access issue with the Fire Marshal and have reached an agreement with him to resolve this concern. With regard to the screening, Dobbs presented a revised screening plan. The plan shows deciduous trees along the eastern edge of the property. There are some existing evergreen trees on the property that Heritage will try to relocate, and there is the possibility that some of these evergreens can be placed along the east property line as well. Fahey pointed out that the property to the east is still zoned residential and there is the possibility that it will develop as such. Fahey suggested that the City would be missing an opportunity to get this area screened if it did not impose the requirements of the ordinance at this time.
