MINUTES <br />CITY COUNCIL <br />MARCH 4, 1998 <br />The Administrator reported that he has heard that the Winter's may feel <br />that their decision not to sell their property was made too quickly. The <br />Administrator su~gested that he talk to them a~ain and provide them with <br />more detailed financing information as well as the potential for the <br />decreased value of their property if the theater backs up against it. <br />DeLonais agreed reporting that he heard it may be worthwhile to talk to <br />them again. <br />Morelan suggested it may be beneficial to get an appraisal done of the <br />Winter's property which reflects the value of the property before and after <br />a theater development. <br />Fahey suggested that if the Winter's are going to make a claim for <br />damages against their property, the City might as well take the property <br />now. The Administrator pointed out that the question is when they make <br />their ciaim. The Winter's may never make a claim, but their heirs may. <br />Pedersen suggested that the City ask the Winter's to sign an agreement <br />waiving damages for any adverse effect. Scalze questioned why they <br />would sign such an agreement. The Administrator suggested that <br />presenting the Winter's with such an agreement may make them think <br />about the effect that the theater would have on their property. The <br />Administrator suggested that he discuss the issue with the Winters and <br />present them with some numbers which estimate the value of the property <br />as well as relocation costs. <br />It was noted that the width of the Winter's property is 204 feet. Council <br />discussed previous Council action requiring a 100-foot buffer to the Iona <br />Lane property noting that such a buffer on the Winter's property would <br />make the property unusable. Fahey noted that when the City rezoned the <br />Rutzick property to allow multiple-family housing, the buf~'er zone <br />requirement was imposed. Fahey stated that he did not feel the City was <br />under any obligation to provide a buffer zone on commercial property <br />abutting Rice Street. <br />Morelan pointed out that the Iona Lane residents will expect the buffer <br />zone to be extended onto the Winter's property. Morelan pointed out that <br />the .91 acres includes the 100-foot buffer already. <br />Pedersen stated that he preferred Plan A to Plan B, but asked if it were <br />possible to buffer the theater from the apartments to the east. Morelan <br />suggested that the back of the theater would have to be screened with <br />evergreens or false windows. <br />
