Resolution declared adopted.
PUBLIC Mayor Fahey opened the public hearing to consider a Conditional Use
IiEARING - Permit allowing the use of the Norm's Tires' parking lot as off premise
OFF-PREMISE parking for the City Center. Both the Plannin~ Commission and the City
PARKING - Planner have recommended approval.
CITY CENTER
There was no one from the general public present wishing to comment on
this matter.
Upon motion by Scalze, seconded by Morelan, the public hearing was
closed.
Pedersen asked what the liability was to the City for having off-premise
parking on private property. The City Attorney recommended that the
City's insurance carrier be notified of the use of the Norm's parking lot by
the City.
The City Administrator presented the Council with a draft shared parking
agreement. He pointed out that the agreement runs indefinitely, but
contains a cancellation clause that would allow cancellation by either party
with 12 months notice. If the agreement is cancelled, the Administrator
pointed out that parking requirements for the City Center could be met
through the consU~uction of a parking lot on the City's owned property
adjacent to the Norm's Tire property. The Administrator reported that
Norm Strohbeen is reviewin~ the agreement, and has indicated that he is
receptive to working out the shared parkin~ arran~ement.
Mrs. Scalze introduced the following resolution and moved its adoption:
RE,SOI,UTIONNO. 98-3-61-APPROVING THE CONDITIONAL
USE PERMIT AI.I.OWING T~IE USE OF THE NORM'S TIRES'
PARKING I,OT AS OFF-PREMI.SE PARKING FOR TFIB CITY
