MINUT~S
CITY COUNCIL
JUNE 24, 1998
that was granted for the house to the north. The propeity is currently
zoned B-3, and Krienl<e requested that the rezoning to RB not be finalized
until the purchase by the McMillln's is finalized. Krienke felt the coffee
shop would be a wonderful addition f'or the neighborhood and supported
the McMillan's request.
There was no one else from the general public present wishing to
comment on this matYer.
Upon motion by LaValle, secouded by I?edersen, the public hearin~ was
closed.
Morelan asked why the City would rezone this lot and not the others
located to the east alou~ County Road C which are zoned B-3. Morelan
suggested that to rezonejust the one lot would be spot zoning.
LaValle stated tl~at I~e did not consider Yhis spot zoning, but cather a
transitional zoi~ii~~.
Fahey sug~ested that these other IoYS wotiild have less of an argument for a
variance given that the other lots are interior lots rather than corner lots.
Morelan felt that RB zoning was a good transitional use for the area, and
suggesCed that staff look at the feasibility of rezouing the remaining B-3
lots to R13. Pahey suggested that staff' prepare a recommendltion for the
Council on this issue.
Morelan as]<ed if the rezoning of 89 West County Ro1d C could be
contingent upon the s11e of the property. The City Attorney replied that it
could be.
Mr. LaValle introduced the followin~ resolution and moved its adoption:
RE,SOI.DTIQNNO. 98-6-I>0-APAROf/ING THE 12EZONINC OF 89
WEST CODNTY IZOAD C FROM GGNERAI, 13DSINESS (B-3) TO
RE.S'IDENTIAL BUSLNESS (R73)CONTINGENT UPON
FINAI IZATION OF THE 2EZON/NC UPON P(IRCFIASE OF TFIE
PROPERTY BYDOUG AND JAN MCMII,I,AN, APPROVZNG THE
CONDlTIONAI.
