Resolution declared adopted. <br />CUP TO ALLOW Mayor Fahey opened the public nearing to consider the application made <br />SHED/ by Hardees' Restaurant, 3354 Rice Street, for an amendment to their <br />ENCLOSURE - Conditional Use Permit allowing a shed/enclosure on their property. It <br />3354 RICE STR: was noted that the Planning Commission recommended approval of this <br />HARDEES' CUP amr;ndment. <br />Fahey asked if the building materials used for the shed met the City's <br />architectural guidelines. The City Planner noted that the shed is painted to <br />match the building. The Planner also noted that the structure is <br />insignificant in relation to the Hardees' buildin~, and felt there was no <br />problem from the standpoint ofthe architectural standards. <br />There was no one present from the general public presenting wishing to <br />comment on this matter. <br />Upon motion by LaValle, seconded by Morelan, the public hearing was <br />closed. <br />The City Administrator reported that the shed had a roof on it, which was <br />removed ~iven that a roof would trigger additional buildin~ code issues <br />which must be complied with. Therefore, the structure that the Council is <br />acting upon is more of a screening-type enclosure. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />
