MINUTES <br />CITY COUNCIL <br />OCTOBER 28, 1998 <br />GILANDERI Mayor Fahey opened the continued Public Hearing to consider the <br />ADDITION - preliminary plat for the Gilanderi Addition. Fahey noted that both the <br />PRELIMINARY City Planner and City Engineer have recommended a conditional <br />PLAT approval of the plat. <br />Mr. Dick Kimmes, developer of Gilanderi Addition, reported that the <br />drainage plan for the property has been redesigned from what was <br />previously presented to the Council. The ponding which had originally <br />been proposed on Lot 1 has been moved to the southwest corner of the plat <br />on the backs of Lots 4 and 5. As a result of the pond relocation, less trees <br />will be lost. Kimmes reported that the pond is not designed to hold water <br />permanently, and there will seldom be standing water in the pond. <br />Fahey pointed out that the City Engineer has raised concerns with the <br />pond. Kimmes reported that some of the details of the topography are a <br />little misleading, and there will be some minor engineering issues which <br />need to be worked out before the plat will be ready for final approval. <br />Fahey stated that he is uncomfortable acting on the preliminary plat until <br />the drainage issues are resolved. Fahey pointed out that resolution of <br />those issues could affect the layout of the plat. Fahey noted that the City <br />Planner has indicated that the lot sizes meet the City's minimum <br />requirements. Therefore, drainage appears to be the issue that needs to be <br />resolved. <br />Kimmes reported that there is a low-lying area on Lot 1 from which <br />drainage runs off onto the adjacent property to the west. As a result, an <br />easement will be needed from that property owner, Brian Ducharme, <br />allowing for some minor grading to be done to get water to drain as shown <br />on the plat. Kimmes indicated that there are no problems with the <br />drainage of Lots 2 through 5. Kimmes indicated that when he originally <br />talked to Ducharme, he did not have a problem granting an easement. <br />However, when the first plan was presented, a pond extended onto the <br />Ducharme property, and Brian Ducharme did not want to grant an <br />easement for ponding. The revised drainage plan provides for a swale on <br />the Ducharme property. <br />Scalze questioned how the City can make assumptions that Mr. Ducharme <br />would be willing to grant an easement for the swale. The City <br />Administrator indicated that final plat approval could not be granted <br />without this easement. <br />Kimmes indicated that an alternative would be to put a retainin~; wall on <br />Lot 1. Scalze asked if the owners of Lot 1 would be required to maintain <br />such a retainin~ wall. Kimmes was unsure. He indicated to the Council <br />2 <br />
