MINUTES <br />CITY COUNCIL <br />DECEMBER 17, 1998 <br />RESOLUTIONNO. 98-12-293 -ACCEPTING THE FEASIBII.ITY <br />REPORT AND CALLING A PUI3LIC HEARING TO CONSIDER THE <br />IMPROVEMENT OF VIKINC DRI[~E FROMMCMENEMYROAD <br />TO EDGERTON.STREET BYSTREET RECONSTRUCTION, <br />CONCRETE CUR73 AND GUTTER, CONCRETE DRIVEWAY <br />APRONS, WATER MAIN, AND STORMSEWER FOR TUESDAY, <br />JANUARY 19, 1999 AT 7:15 P. M. <br />The fore~oing resolution was duly seconded by Pedersen. <br />Ayes (5) Morelan, Pedersen, Fahey, LaValle, Scalze. <br />Nays (0). Resolution declared adopted. <br />With regard to the improvement of LaBore Road and McMenemy Road, <br />the City Administrator reported that assessment options were discussed for <br />the concrete curb and gutter. These assessment options are complicated <br />by the fact that the City Engineer has determined it will not be feasible to <br />install concrete curb and gutter in all areas along these streets. Options <br />include assessing affected properties for the curb and gutter, or spreading <br />the cost amon~ all properties fronting on these streets. The Administrator <br />reported that at the neighborhood meeting there was not a strong sense of <br />objection to the curb and gutter. However, a petition against this portion <br />of the improvement has been submitted by the property owners. <br />Fahey noted that past policy has been to assess 85% of the cost of concrete <br />curb and gutter against affected front foota~e. The Administrator agreed <br />that this has been past City policy. Another option would be assessing on <br />a per unit basis. <br />Fahey felt that the City should be consistent with its assessment policy, <br />and pointed out that the Council has spent a lot of time developing this <br />policy. Fahey felt that the current policy shoutd be applied unless there is <br />a compelling reason not to. <br />Scalze pointed out that concrete curb and gutter were installed along <br />Jackson/Old County Road C/Lakeshore even though there was 100% <br />opposition to this portion of the improvement. Scalze indicated that she <br />would have difficulty in eliminatin~ concrete curb and gutter from the <br />improvement unless there were some drastically different circumstances. <br />The City Administrator pointed out that City staf'Fdoes not recommend <br />eliminating concrete curb and gutter from the improvement. The <br />Administrator pointed out that the County typically installs bituminous <br />curb and gutter as part of its improvements. The City is recommending an <br />12 <br />
