MINUTES <br />CITY COUNCIL <br />JANUARY 27, 1999 <br />to whether or not to approve a rezoning just as it does with any <br />rezoning action. <br />Fahey pointed out that calling the use an interim use acknowled~es <br />that the City does not feel this is the highest and best use for the <br />property, but a use that the City is interested in allowing for only a <br />period of time. <br />Sca(ze asked ifthe City should extend the development agreement <br />providing anothersunset period. <br />Fahey pointed out that the City Attorney is recommendin~ that the <br />interim use district is the appropriate way to handle the situation. <br />The Attorney indicated that there was a need to clarify the exact <br />stat~as of the business. <br />The Council discussed an appropriate time period for allowing the <br />recycling operation to continue. Morelan felt that at some point <br />the property would be too valuable for that operation. Pedersen <br />suggested that the City would not want the business to continue <br />indefinitely, but if the market says the property is not good for <br />anything else, then why not let the business continue. Pedersen <br />felt that the property owner should be smart enough to know when <br />the property is worth more as another use. <br />Frattalone stated that he understands where the City is coming <br />from and agrees that some day it may not be feasible to operate the <br />recyclin~ business at this location. Frattalone stated that if the <br />interim use provides for a sunset on the business, he would like the <br />ordinance language to also include a provision allowing him to <br />request an extension. Frattalone stated that he always wanted to <br />operate the recyclin~ business on a permanent basis, and that is <br />why he has asked for extensions to this business. Frattalone <br />suggested a 20-year interim use with the ability to ask for an <br />extension if he chooses. <br />The City Attorney stated that he assumed that the interim use could <br />be established for a definite period of time with Frattalone having <br />the ability to apply again. <br />Frattalone presented the Council with a landscape plan for the <br />north side of his property as well as the entrance area to Ryan <br />Industrial Park. This plan included (andscaping on both sides of <br />Ryan Drive, which Frattalone indicated that he would be willing to <br />maintain. If possible, he would be willin~ to put slats in the <br />16 <br />
