With regard to a license <br />fee, Frattalone proposed 10 cents per yard of recycled material, <br />which he estimated would amount to between $6,000 and $10,000 <br />per year. Frattalone proposed that this money be put toward <br />landscaping and cleaning up Ryan Industrial Park, and indicated <br />that he would be willing to work with the Code Enforcement <br />Of~'icer to get this done. <br />Fahey stated that he supported the recommendation of the City <br />Attorney to clean up this situation from a legal standpoint. Fahey <br />proposed that the interim use be established for a 10-year period, <br />althou~h he indicated that he could support a longer time period. <br />LaValle suggested 15 years. <br />Scalze pointed out that whatever is done for Frattalone will affect <br />other properties in the area. <br />Fahey suggested that the interim use be limited to the existing <br />owner, with the use to cease if ownership of the property chan~es. <br />Fahey pointed out that the City knows the type of operation that <br />Frattalone operates. <br />The,City Administrator suggested that there would be a <br />development agreement that would coincide with the interim use <br />ordinance. This development agreement would address issues of <br />transfer of the property, license fee, etc. <br />LaValle suggested the interim use be a(lowed for a 15-year period. <br />Fahey suggested that in 10 years the City should know where the <br />recycling business is at. Morelan stated that a 10-year period was <br />acceptable to him. Fahey suggested that the City Attorney and <br />staff work out the details and present a recommendation to the <br />Councii. <br />Frattalone asked if development agreement would allow the <br />interim use to be re-applied for at the end of whatever the time <br />period is set at. Fahey replied that it could. Fahey also suggested <br />that the development agreement provide for the recession of the <br />use should the ownership of the business change. <br />Mr. Morelan introduced the following resolution and moved its <br />adoption: <br />17 <br />
