MINUTES <br />CITY COUNCIL <br />JANUARY 27, 1999 <br />TERRACE of the plat subject to compliance with the recommendations of the <br />THIRD ADD. the City Planner and City Engineer, subject to submission of <br />satisfactory grading and landscaping plans, and subject to the <br />insta(lation of additional landscaping on the eastern edge of the <br />berm in conjunction with the expansion of the Slumberland <br />parking lot, but no later than August 1, 2001 if the parking (ot <br />expansion does not occur. <br />Fahey pointed out that the City Engineer has indicated that <br />easements around the perimeter of the plat have not been shown, <br />and asked if that has been resolved. Fahey also expressed concern <br />with the landscaping issue and asked how the City could ensure <br />that the landscaping is completed no later than August 1, 2001. <br />Frank Frattalone, the developer, indicated that he would be willing <br />to post a bond relative to the landscaping issue. Frattalone pointed <br />out that the majority of the berm is already landscaped. The <br />landscaping on the eastern end of the berm has not been done at <br />the request of Slumberland. Slumberland informed him that they <br />are thinking about expanding their parking lot, and asked that the <br />trees not be planted at this time since if the parking lot expansion <br />proceeds, the trees would have to be relocated. <br />Fahey felt that the landscaping issue would need to be addressed in <br />the Development Agreement with a bond requirement. <br />Morelan asked on whose property the berm is located. Frattalone <br />reported that originally the berm was on the Slumberland property. <br />As part of the Pitrina Park development, he made the berm higher <br />and sloped it onto the Pitrina Park property. Frattalone <br />acknowledged that Slumberland existed prior to Pitrina Park, <br />therefore, the burden of providing a buffer was his. Frattalone <br />pointed out, however, that if Slumberland makes changes on their <br />property, then they should have some responsibility for buffering <br />as well. <br />Scalze was concerned that the buffering is on the Slumberland <br />property without any agreement from Slumberland allowing for the <br />maintenance of this buffering. <br />Frattalone pointed out that he has agreed to install the buffering, <br />and felt that Slumberland should not have the ability to remove it. <br />
