MINUTES <br />CITY COUNCIL <br />JANUARY 27, 1999 <br />Fahey felt that a written agreement was needed with Slumberland <br />acknowled~ing that Mr. Frattalone has the right to install the <br />buffering and agreeing that they will not remove it. <br />Frattalone pointed out that when Slumber(and developed, the <br />property to the south was also zoned Industrial-Park, therefore, <br />Stumberland was not required to buft'er. However, given that the <br />property to the south is now zoned R-2, Frattalone did not be(ieve <br />Slumberland would have the ability to remove buf~'ering. <br />Morelan stated that he felt the City could prevent Slumberland <br />from removing the buffer, but did not feel the City could require <br />Slumberland to add to the buf~'er. Morelan felt that the City <br />needed a written a~reement from Slumberland indicating that the <br />existing berm would remain or be relocated should they proceed <br />with the expansion of their parking lot. More(an suggested that, <br />otherwise, an option would be to require the berm on the Pitrina <br />Park site. <br />Frattalone reported that about 85% of the berm and trees are <br />located on the Slumberland property. Frattalone pointed out that <br />he is agreeable to completing the landscapin~ on the eastern edge <br />of the berm by August 1, 2001 if Slumberland does not proceed <br />with the parkin~ lot expansion. Frattalone stated that he <br />acknowledged the questions raised by the Council and indicated <br />that he could ~;o to Slumberland to ask for the agreement the City <br />wants. <br />Fahey suggested that Frattalone either obtains the agreement from <br />Slumberland or else revise the plat to show the berm on his <br />property. <br />Frattalone pointed out that the berm existed on the Slumberland <br />property and that as part of the Pitrina Park development he <br />extended the berm about 300 feet. He had also proposed to plant <br />trees all the way down the length of the berm. Frattalone pointed <br />out the ponds he has installed on the property that would make it <br />difficult to move the berms onto his property unless he used <br />retai,ning walls. Frattalone stated that there is some room near Lots <br />1 and 2 to move the berm further onto his property. <br />Frattalone presented a landscape plan for Pitrina Park Terrace <br />Third Addition. However, it was noted that the additional <br />landscaping for the berm was not shown on the plan. Fahey <br />sug~ested that the plan be modified to include that landscaping. <br />
