MINUTES <br />CITY COUNCIL <br />MARCH 24, 1999 <br />perform in order to award to the second low bidder. The City has had <br />problems with this particular contractor with regard to timely construction. <br />However, that in itself is not enough to made this bidder an irresponsible <br />bidder. The City Attorney indicated, however, that there could be some <br />case law on this issue that he is not aware of and indicated that he would <br />research the matter. <br />Fahey suggested that action awarding the bid be tabled until the next <br />meeting in order to give the City Attorney time to research case law as <br />well as the City Engineer time to establish the relationship between Valley <br />Paving and North Valley. <br />Morelan indicated that if the companies were separate entities with no ties, <br />he could support awarding the bid to North Valley. Fahey asked the <br />Engineer to determine if North Valley was a newly formed company, with <br />no established track record. He suggested that articles of incorporation be <br />verified, length of time doing business, etc. and that this information be <br />available for the next Council meeting. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOI.UTIONNO. 99-3-69- TAI3LINGACTIONONAW.9RD OF <br />73ID FOR THE I999 IMPRO vEMENT.S UNT77. MEETING PENDING A REPORT FROM THE <br />CITYATTORNEYAND CITYENGINEER <br />The Foregoin~ resolution was duly seconded by Scalze. <br />Ayes (4) Fahey, Scalze, LaVal(e, Morelan. <br />Nays (0). Resolution declared adopted. <br />1999 SEWER Fahey noted that the City Administrator has prepared the 1999 Bud~ets <br />& WATER for the Sewer and Water accounts, and is proposing a 3 1/2% increase <br />BUDGETS AND in water rates and a zero percent increase in sewer rates. <br />RATES <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOI. UTION NO. 99-3- 70 - ADOPTING THE 1999 SEWER AND <br />WATER BUDGETS AS PRESENTED I3Y THE CITY <br />ADMINISTRATOR AND INCREASING WATER RATES BY 31/2 <br />PERCENT AS RECOMMENDED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Scalze, LaValle, Morelan, Fahey. <br />Nays (0).
