MINUTES <br />CITY COUNCIL <br />MARCH 24, 1999 <br />Morelan asked the business arrangement between North Valley and Valley <br />Paving. The Engineer replied that he was not totally sure, but indicated <br />that Brad informed him that they were two totally separate operations. <br />Morelan asked if any of the principles involved in the company a few <br />years ago were a part of North Valley. <br />The City Administrator reported that this was unclear, but indicated that <br />his experience with Brad is that he was reasonable to deal with, but he did <br />not make the decisions a few years a~o. The Engineer reported that he <br />tried to meet with North Valley today, but was unable to do so. <br />Morelan indicated that he was uncomfortable with awarding the bid to <br />North Valley based on the City's previous experience. <br />Scalze asked what the City's options were. <br />Fahey indicated that the option would be to reject all bids and start over. <br />Morelan felt that the City should be able to award to the next lowest <br />bidder and not to North Valley based on the City's previous experience. <br />Fahey noted that the City prevailed in court on the Valley Paving project a <br />few years ago, and also noted that at the time the City was not satisfied <br />with the work that previous City En~ineer was doin~. <br />Morelan felt the City lost the case in court, althou~h pointed out that <br />Valley Pavin~ did not get as large a sett(ement as it wanted. <br />The City Administrator discussed the issues of weather, lack of a full-time <br />inspector, lack of flagging, etc. which plagued the previous project. The <br />Administrator pointed out that the City's specifications have been changed <br />to address these issues. The Administrator indicated that the City had <br />good specs on the previous project, however, the City's representative did <br />not use them. <br />The City Attorney pointed out that the City's specs provide for the <br />rejection of all bids. <br />Morelan stated that he would like to see the project awarded to the second <br />low bidder. <br />The City Attarney reported that Chapter 429 provides for awarding of a <br />bid to the lowest responsible bidder. There would have to be <br />recommendations from someone as to defects in the contractor's ability to <br />
