MINUTES <br />CITY COUNCIL <br />APRIL 20, 1999 <br />buildin~s shown by Reiling and Drake were a hodge podge development <br />that the City is trying to get away from. <br />Kelly noted that Messrs. Reiling and Drake have made application for a <br />building permit and noted that the City has no formal agreement with Mr. <br />Linn for the development of this property. Kelley stated that if the <br />moratorium is put in place he would like to know if a variance is needed in <br />order for his clients to repair the roof on the car wash. <br />Jay Reiling appeared before the Council and presented photographs of the <br />property at 2600 Rice Street showing the property both before and after <br />improvements that have already been made. Reiling reported that he made <br />application for a building permit for both the roof and for a sign several <br />weeks a~o. At the time of application, it seemed there would be no <br />problems with these permits. Therefore, he purchased the materials for <br />the roof and hired a sign company to construct the sign. Reilin~ reported <br />that the cost of the sign is $2,860 while the roofin~ materials are $472.62 <br />plus tax. Reiling indicated that the moratorium will stop them from <br />proceeding with development plans for their property and will financially <br />hurt them. <br />Fahey noted that the roofing materials and si~;n were ordered prior to the <br />issuance of building permits. <br />Reiling reported that there was no indication there would be problems <br />with the permits. Reiling also reported that they have a coffee shop tenant <br />for the small block building on the property, and that tenant will go away <br />if the moratorium is put in place. Reiling indicated that the moratorium <br />will hurt them and will stop them from improvin~ their land they way they <br />planned to. <br />Fahey asked when Reiling and Drake purchased the property. Reiling <br />replied that they purchased the property in September of 1998. <br />Fahey felt that the moratorium should be as short as possible, but of a <br />duration to ~ive the City sufficient time to obtain appraisals so the Council <br />can move fonvard with a decision on the property. <br />The Administrator reported that the appraiser has indicated it will take five <br />weeks to complete appraisals given his current workload. If the appraisals <br />are acceptable, review appraisals would have to be done before the City <br />could make offers of just compensation. The Administrator felt a 90-day <br />time period would be adequate for the moratorium. <br />
