MINUTES <br />CITY COUNCIL <br />APRIL 20, 1999 <br />Fahey asked ifthe City would have the ability to extend a 90-day <br />moratorium if it had to. The City Attorney replied that the moratorium <br />could be extended. <br />Fahey felt that the City should resolve the moratorium as soon as possible <br />so that if the City does not proceed with acquisition, the property owners <br />could proceed with their redevelopment plans. Fahey also commented <br />that with regard to the building permit for the roof, while he supported <br />improvements which are necessary from a life or safety standpoint, he did <br />not support allowing the property owners to make improvements to the <br />property that will simply drive up everyone's costs. Fahey felt that <br />existing conditions should be maintained during the short window oftime <br />that the moratorium would be in place so that the City can look at the <br />public need for the property. <br />Reiling felt a 90-day moratorium was long and will cause financial harm. <br />Fahey stated that he understood the concern but was not sure the City <br />could do what it had to in a shorter time period. <br />The City Attorney agreed that 90 days seemed to be a reasonable period of <br />time to complete the appraisal process. <br />Morelan asked if the overall conclusion would be the rezoning of the <br />property. The City Administrator replied that assuming a development <br />agreement was in place with Perry Linn, the next step would be to rezone <br />the property. <br />Scalze asked if Perry Linn had submitted a formal proposal. The City <br />Administrator replied that a formal proposal would not be submitted until <br />the appraisal information is obtained to determine if the project works. If <br />the appraisals are favorable, review appraisals would need to be obtained <br />before the City could make an offer of just compensation. <br />Reiling indicated that he is a long-time Little Canada resident and that <br />2600 Rice Street is his and Drake's business. Reiling reported that they <br />have a lot of money, time, and effort into this project and it will financially <br />hurt them if the City stops them from improvin~ the land while pursuing <br />another development for which the City has no guarantees that the <br />developer will perform. Reiling indicated that he assumes the coffee will <br />go away once the moratorium is put in place. Reiling stated that he was <br />not sure what the financial ramifications of that would be. <br />Scalze asked what assurances Reilin~ has that a coffee shop would work <br />in the building. <br />
