MINUTES <br />CITY COUNCIL <br />MAY 25, 1999 <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOI, UTION NO. 99-S-I23 - CONTINUINC THE PU73LIC <br />HEARING ON THE INTERIM USE PERMIT FOR AGGREGATE <br />MATERIALS STOCKPILINC AND RECYCLING AT 3137 COUNTRY <br />DRIVE, FR,4-DOR, UNTII. THE JUNE 8, I999 REGDLAR COUNCII. <br />MEETING <br />The fore~oing resolution was duly seconded by LaValle. <br />Ayes (4) Fahey, LaValle, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />VARiANCE Fahey opened the public hearing to consider the request for Variance <br />FOR REAR to the rear yard setback requirements for property at 165 East Viking <br />YARD Drive as requested by Mr. Rick Thul. The Planning Commission has <br />SETBACK - recommended approval of the variance request. It was noted that the <br />1G5 E. VI[{ING City Planner recommended denial ofthe request based on the fact it <br />DRIVE - appears there is no hardship present to justify granting the variance. <br />RICK TIIUL <br /> Scalze noted that the reasons the Planning Commission outlined for <br /> granting the variance do not constitute a hardship. <br />Rick Thul indicated that security is the reason for his variance request. <br />Thul reported that he wants to add attached garage space to his house. <br />However, ~iven the amount of garage space he would have exceeds the <br />maximums al(owed by Code, his plan would be to convert existin~ <br />detached ~arage space into livin~ quarters and attach this building to his <br />house. Then he would add the attached garage. The existing garage space <br />at the back of the property is currently 26 feet from the property line. The <br />required minimum setback for garage space is 10 feet. However, the <br />required minimum setback for living quarters from the rear yard is 30 feet. <br />Therefore, a rear yard setback variance is necessary. <br />Thul reported that about a year ago he began researching how he could <br />accomplish what he wanted and was told by the Buildin~ Official and City <br />Planner that this was a feasible plan. Thul indicated that the need for a <br />rear yard setback variance was never brought up. Based on this <br />information, he proceeded to do some internal remodeling to his house and <br />removed bedroom space. Thul reported that when he applied for his <br />building permit for the outside work, he was informed about the need for a <br />setback variance. <br />Scalze felt that this was almost like having two houses on one lot. Scalze <br />questioned that connecting of two structures with a covered walkway <br />
