MINUTES <br />CITY COUNCIL <br />JUNE S, 1999 <br />Scalze pointed out that Frattalone first obtained a fill permit for this <br />property in 1983, and sug~ested that perhaps a five-year term would be <br />more appropriate for the stockpiling and recycling use. <br />Fahey indicated that the Council has already debated the term and <br />consensus was for ten years. Fahey again stated that he would like to see <br />alternatives. He pointed out that this business appears to be a viable one, <br />and su~;~ested that Mr. Frattalone was a wise businessman who will <br />upgrade the use of the property when the time comes. <br />Scalze stated that the recyclin~ operation is not the hi~hest and best use of <br />this site. Morelan sug~ested that this is why the City is requirin~ the <br />license fee to offset the revenue that the City receives given that the <br />property is not developed to its potential. <br />Morelan stated that he would approve staff" s recommendation for the <br />$500,000 bond. However, if Frattalone cannot accept that requirement, <br />then additional research is needed into alternatives. <br />Frattalone pointed out that the maximum amount of materials that can be <br />stored on the site is 40,000 yards. That maximum is on site only about 30 <br />days each year, with much less materials the remainder of the year. <br />Therefore, the amount of the bond should reflect the cost of removal for a <br />lesser amount than 40,000 yards. Council did not agree and suggested that <br />the bond should cover the maximum amount of materials. <br />Frattalone stated that he would like to have a decision on the Development <br />Agreement so that he does not have to continue to attend Council <br />meetings. Frattalone indicated that, if necessary, he will post a$500,000 <br />bond, but did not feel that hi~h an amount was necessary and was <br />concerned about tying up that amount of bondability. Frattalone stated <br />that he would prefer to work with the City Administrator on identifying <br />other options. <br />Fahey a~reed that Frattalone should work with the City Administrator and <br />City Attorney to identify options. Fahey suggested that if the City <br />Administrator and Frattalone reached an a~reement, a recommendation <br />could be placed on the Consent Agenda for Council action. <br />There was no one from the ~eneral public present wishin~ to comment on <br />this matter. <br />Upon motion by Fahey, seconded by LaValle, the public hearing was <br />closed. <br />
