MINUTES <br />CITY COUNCIL <br />JUNE 22, 1999 <br />first building, which before the Council this evening, meets the City's <br />parking requirements. <br />Morelan pointed out that the setback issue from Country Drive. He also <br />noted that the Kandice Hei~hts I building has a less than standard setback. <br />The City Planner indicated that the Kandice I building setback is a factor <br />of how the road sits within the ri~ht-of-way as well as the varyin~ <br />amounts of right-of-way width along Country Drive. <br />Morelan suggested that perhaps the City should look at the possibility of <br />vacating a portion of the right-of-way in order to make the setback for this <br />buiiding conformin~. <br />The City Planner noted that the location of utilities within the right-of-way <br />would be a factor to consider as part of any vacation process. <br />There was no one else from the general public present wishin~; to <br />comment on this matter. <br />Upon motion by LaValle, seconded by Scalze, the public hearing was <br />closed. <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />RESOI, UTION N0. 99-6-152 - APPRO 1~ING THE PREI.IMINARY <br />PI AT FOR COUNTRY,SIDE TERRACE OFFICE PARKAND A PUD <br />PERMIT TO AI.LOW TFIE CON.STRUCTION OF ONE OFFICE <br />I3UILDING.SUI3JECT TO COMPLIANCE WITFI THE <br />RECOMMENDATION.S OF THE PI.ANNlNG COMMISSION, <br />PARK.S' & RECREATION COMMISSION, CITY PLANNER, CLTY <br />ENGINEF,R, AND CITY STAFF, AND ,S~UI3.IECT TO THE <br />DEVELOPER ENTERING INTO A DEVEI,OPMENT AGREEMBNT <br />WITH TFIE CITY <br />The fo~egoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Fahey, Pedersen, LaValle. <br />Nays (0). Resolution declared adopted. <br />ARCHITEC- The Council reviewed the signa~;e proposed by Hardee's Restaurant at <br />TURAL 3354 Rice Street. Fahey noted that Hardee's has modified their proposal <br />REVIEW - from what was presented at the Planning Commission meeting, and it now <br />HARDE~'S meets the City's architectural review standards. <br />SIGN Mr. Morelan introduced the following resolution and moved its adoption: <br />20 <br />
