MINUTES <br />CTTY COUNCIL <br />JUNE 22, 1999 <br />stated that the City did not need a development agreement to hold to the <br />City standard that lots must have access on an improved public street. <br />IClidzejs asked to receive a copy ofthe development agreement. She also <br />noted that there are many reasons not to improve Mitchell Trail. Klidzejs <br />reported that this is an old, heavily wooded area, and did not feel it needed <br />to become a cookie-cutter neighborhood. Klidzejs also reported that in the <br />years she has lived in her home there has never been a problem with <br />garbage trucks or emergency vehicles getting to her house. <br />Scalze pointed out that the Klidzejs lots were created in 1985 with the <br />a~;reement that Mitchell Trail would be improved when the Mitchell <br />property developed. <br />Klidzejs requested that the City look at the total picture. She pointed out <br />that the developer is willing to develop three lots fronting on Twin Lake <br />Road without need for the new road. Klidzejs also pointed out that the <br />current situation has been workable for the past several years. She asked <br />the Council to come out and look at the property so they can get a feel for <br />what a road improvement will do to this area. Klidzejs suggested that the <br />issue is not as cut and dried as the Council seems to indicate and pointed <br />out that people's emotional feelin~s are involved as well. Klidzejs felt the <br />road should not be improved unless there was a very good reason to do so. <br />She did not feel enou~h reasons were expressed to warrant the road ~;oing <br />in. <br />Scalze stated that the Council has to be fair to everyone in the City. If the <br />Council allows these homes to continue to exist without road frontage, <br />there will be other similar requests made. Fahey a~reed, and pointed out <br />that the City has turned down similar requests in the past. Fahey pointed <br />out that the Klidzejs' family accepted the fact that the road would go in <br />some day back in 1985 when their property division was approved. <br />Mr. Leopold Klidzejs, 3248 Twin Lake Road, pointed out that this road <br />will destroy their beautiful yards. He also indicated that 3246 Twin Lake <br />Road would not even access the street since they use a driveway on the <br />north side of the property. Klidzejs reported that he agreed to the road <br />easement as part of the property division because that was the only way <br />the City would approve the property division. Klidzejs also pointed out <br />the placement of his son's house that would be in line with the road and <br />may present a setback problem. <br />Alex Klidzejs, 3244 Twin Lake Road, repa-ted that his house is 28 feet <br />from the property line. If the City improved the road, it may be too close <br />to his house. <br />6 <br />
