MINUTES <br />CITY COUNCIL <br />SEPTEMBER 22, 1999 <br />Pedersen asked Howe how he felt about a rear yard setback variance for <br />the northern units rather than the eastern units. <br />Howe replied that he could remove the porches from the eastern units and <br />add them to the northern units. However, he will still need front yard <br />setbacks from Bryan Street of 25 feet from the right-of-way that is 35 feet <br />from the street. Howe pointed out that the townhomes in Cobblestone <br />Village are 22 feet from the street and felt this has worked well. <br />Pedersen asked about setbacks from a private road versus a public road. <br />The City Administrator replied that the right-of-way width for a private <br />road is typically narrower and the setback issue may disappear as a result. <br />However, the Administrator suggested that if the street were private and <br />maintained by a townhome association, the City might be faced with a <br />future request for the City to take over the road. Therefore, he has <br />encouraged Mr. Howe to propose a public street that would be constructed <br />to City standards. The Administrator also pointed out Mr. Howe has <br />assembled a difficult site that results in substantial redevelopment for the <br />community without City financial assistance. He also noted that this is a <br />good use given surrounding zoning of multiple family, single family, and <br />commercial. Lastly, signiflcant land dedication to the public is occurring <br />with this project. Therefore, he recommended the PUD zoning. <br />Pedersen indicated that he supported the public street as well as <br />negotiation of setbacks for this development. Morelan felt there was not <br />justification for reduced setbacks other than economics. Morelan felt the <br />units could be redesigned to meet the City's setback standards. <br />Fahey felt the property should be rezoned to PUD to provide for some <br />flexibility with setbacks. He pointed out the unique circumstances in <br />assembling the property for this development as well as the additional <br />right-of-way required for Little Canada Road and the park dedication <br />being made by the developer. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 99-9-250 -APPROVING THE CONCEPT <br />REZONING OF THE PROPERTY AT LITTL~ CANADA ROAD AND <br />JACKSON STREET FOR THE GORDIE HOWE TOWNHOME <br />PROPOSAL TO PI.ANNED UNIT DEVEI,OPMENT (PUD) <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Scalze, LaValle, Pedersen, Fahey. <br />Nays (1) Morelan. Resolution declared adopted. <br />
