MINUTES <br />CITY COUNCIL <br />SEPTEMBER 22, 1999 <br />Scalze felt that due to the oversized park and the additional right-of-way <br />for Little Canada Road as well as the fact that the developer had to <br />assemble several parcels, reduced setbacks were justified. Scalze also <br />noted that the property owners in the area are not voicing much opposition <br />to Mr. Howe's proposal. <br />The City Administrator suggested that the vacation of five feet of Jackson <br />Street requested by Mr. Howe did not appear to be a problem. Morelan <br />asked if the vacation would include the entire length of Jackson. The <br />Administrator reported that could be done if the other abutting property <br />owners were interested in the vacation. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RE,SOLUTIONNO. 99-9-251-APPROVING THE CONCEPT FOR A <br />TOWNHOME DEVELOPMENT AT LZTTLE CANADA ROAD AND <br />JACKSON STREET AS PROPOSED 73Y GORDIE HOWE <br />ALLOWING FOR FRONT YARD SET73ACKS AI.ONG ]3RYAN <br />STREET OF 25 FEET, REAR YARD SETI3ACK VARIANCES FOR <br />THE TOWNHOMES (WITH PORCHES) AT THE NORTH OF THE <br />SITE A73UTTING THE PARK, AND RE~UIRING 30-FOOT REAR <br />YARD ,SETI3ACKS FOR THE TOWNHUMES TO I3E LOCATED ON <br />THE EAST OF THE SITE <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) LaValle, Pedersen, Fahey, Scalze. <br />Nays (I) Morelan. Resolution declared adopted. <br />Scalze asked if Mr. Howe would be required to comply with streetscape <br />requirements along Little Canada Road. The City Planner replied that <br />these standards would be applied as the project progresses. <br />CONCEPT Mayor Fahey noted that the Planning Commission voted three to two to <br />DISCUSSION recommending that the present zoning of the Buetow and McCumber <br />FOR REZONING properties be retained. <br />OF BUETOW <br />AND McCUMBER Mr. Ed McCumber reported that in addition to a petition he submitted <br />PROPERTIES at the Planning Commission meetin~ of neighboring property owners <br /> opposed to the rezoning of the Buetow and McCumber properties, he has <br /> additional signatures on that petition. McCumber presented the expanded <br /> petition. McCumber reported that of all the properties he visited, only two <br /> property owners refused to sign the petition. <br />
